(b) For purposes <strong>of</strong> this section, the term ‘human embryo orembryos’ includes any organism not protected as a human subject under 45 CFR Part 46 as <strong>of</strong> the date <strong>of</strong>the enactment <strong>of</strong> this Act, that is derived by fertilization, parthenogenesis, cloning, or any other meansfrom one or more human gametes or human diploid cells.”The NIH has published final guidelines on the allowability <strong>of</strong> Federal funds to be used for research onhuman embryonic stem cell lines. The URL is http://stemcells.nih.gov/index.asp.LIMITATION ON USE OF FUNDS FOR PROMOTION OF LEGALIZATION OFCONTROLLED SUBSTANCES (Section 510)“(a) None <strong>of</strong> the funds made available in this Act may be used for any activity that promotes thelegalization <strong>of</strong> any drug or other substance included in schedule I <strong>of</strong> the schedules <strong>of</strong> controlledsubstances established by section 202 <strong>of</strong> the Controlled Substances Act (21 U.S.C.812). (b)The limitationin subsection (a) shall not apply when there is significant medical evidence <strong>of</strong> a therapeutic advantage tothe use <strong>of</strong> such drug or other substance or that Federally sponsored clinical trials are being conducted todetermine therapeutic advantage.”RESTRICTION ON DISTRIBUTION OF STERILE NEEDLES (Section 505)“None <strong>of</strong> the funds contained in this Act may be used to distribute any needle or syringe for the purpose<strong>of</strong> preventing the spread <strong>of</strong> blood borne pathogens in any location that has been determined by the localpublic health or local law enforcement authorities to be inappropriate for such distribution.”RESTRICTION ON ABORTIONS (Section 507)“(a) None <strong>of</strong> the funds appropriated under this Act, and none <strong>of</strong> the funds in any trust fund to which fundsare appropriated under this Act, shall be expended for any abortion.”(b) None <strong>of</strong> the funds appropriated in this Act, and none <strong>of</strong> the funds in any trust fund to which funds areappropriated in this Act, shall be expended for health benefits coverage that includes coverage <strong>of</strong>abortion.(c) The term “health benefits coverage” means the package <strong>of</strong> services covered by a managed careprovider or organization pursuant to a contract or other arrangement.”EXCEPTION TO RESTRICTION ON ABORTIONS (Section 508)“(a) The limitations established in the preceding section shall not apply to an abortion—(1) if the pregnancy is the result <strong>of</strong> an act <strong>of</strong> rape or incest; or(2) in the case where a woman suffers from a physical disorder, physical injury, or physicalillness, including a life endangering physical condition caused by or arising from the pregnancyitself, that would, as certified by a physician, place the woman in danger <strong>of</strong> death unless anabortion is performed.(b) Nothing in the preceding section shall be construed as prohibiting the expenditure by a State, locality,entity, or private person <strong>of</strong> State, local, or private funds (other than a State’s or locality’s contribution <strong>of</strong>Medicaid matching funds).(c) Nothing in the preceding section shall be construed as restricting the ability <strong>of</strong> any managed careprovider from <strong>of</strong>fering abortion coverage or the ability <strong>of</strong> a State or locality to contract separately withsuch a provider for such coverage with State funds (other than a State’s or locality’s contribution <strong>of</strong>Medicaid matching funds).Part III: Policies, Assurances, Definitions, and Other InformationIII-20
