CONSERVATION AREA STATEMENT – CONSERVATION AREA NO. 16 – TOP OF TOWNPolicy BE7:A change of use of a building in aConservation Area will be permitted if both thefollowing criteria are met:1. The new use will not require any changes inthe appearance or setting of the building,other than those which will preserve orenhance its contribution to the character orappearance of the <strong>area</strong>; and2. Any traffic generation, vehicle parking ornoise can be catered for in a way thatpreserves or enhances the character orappearance of the <strong>area</strong>.Policy BE13:Development will not be permitted where itwould involve significant alteration or causedamage to nationally important archaeologicalremains (whether scheduled or not) or wouldhave a significant impact on the setting ofvisible remains.Policy BE14:Development that affects archaeologicalremains of other than national significance willnot be permitted unless the importance of thedevelopment outweighs the value of theremains.Local Plan policies for developmentaffecting a Listed BuildingThe <strong>Stroud</strong> Town Centre Conservation Areaincludes a great number of listed buildings, as isoften the case in high quality historicenvironments. The following policies are usedto assess development affecting a listedbuilding or it’s setting, where that developmentrequires planning permission.When considering applications for ListedBuilding Consent, the Planning Authority refersto government policy guidance in the form ofPPG15: Planning and the HistoricEnvironment, rather than to Local Planpolicies.Policy BE8:Development involving the total demolition ofa listed building will not be permitted unlessthere are very exceptional circumstances,where all the following criteria are met:1. The listed building concerned is aGrade II Listed Building;2. The condition of the building is suchthat the cost of repairing andmaintaining the building outweigh itsimportance, and the value derived fromits continued use;3. There is no other viable use for thebuilding; and4. The demolition of the building will notcause harm to the setting of any otherlisted building, the character of aConservation Area, or the character ofa street scene.Policy BE9:Development involving the partial demolitionof a listed building, or the demolition of aCurtilage listed building, will only be permittedwhere the demolition will achieve thepreservation of the listed building and itssetting.Policy BE10:Development involving proposals to extend oralter a listed building, or any feature of specialarchitectural or historic interest that contributeto the reasons for its listing, will not bepermitted unless it would preserve thebuilding, its setting, and any features of specialarchitectural or historic interest the buildingpossesses.Policy BE11:A change of use of all or part of a listedbuilding will be permitted only if it wouldpreserve the building, it’s setting, and anyfeatures of special architectural or historicinterest the building possesses.Policy BE12:A proposal for development that affects thesetting of a listed building will only bePage - 36 -
