CONSERVATION AREA STATEMENT – CONSERVATION AREA NO. 16 – TOP OF TOWNDevelopment within the curtilageof a dwelling house:Class A The enlargement, improvement or otheralteration of a dwelling houseClass B The enlargement of a dwelling houseconsisting of an addition of alteration toits roofClass C Any other alteration to the roof of adwelling houseClass D The erection or construction of a porchoutside any external door of a dwellinghouseClass H The installation, alteration orreplacement of a satellite antenna on adwelling house or within the curtilageof a dwelling house[The above being developmentcomprised within Part 1, Classes A, B,C, D and H referred to in Schedule 2 ofthe Town and Country Planning(General Permitted Development)Order 1995, and not beingdevelopment comprised within anyother part]Minor Operations:Class A The erection, construction,maintenance, improvement or alterationof a gate, fence, wall or other means ofenclosureClass C The painting of the exterior of anybuilding or work[The above being developmentcomprised within Part 2, Classes A andC, referred to in Schedule 2 to the saidOrder (1995), and not beingdevelopment comprised within anyother part]Unoccupied buildingsBREACHES OF PLANNING CONTROL ANDENFORCEMENTIt is a criminal offence to execute, or cause tobe executed, without first obtaining ListedBuilding Consent, any works for the demolitionof a listed building, or any works of alterationor extension, which would affect its specialinterest. This includes theft of architecturalfixtures, for example chimneypieces, wallpanelling, plastered ceilings, doors, etc. It isalso an offence to fail to comply with the termsof any condition attached to a Consent.A survey of all the Listed Buildings in <strong>Stroud</strong>was carried out in early 1993. The purpose ofthis survey was to obtain the informationnecessary to analyse the condition of the ListedBuildings and to provide a register of thoseconsidered to be at risk. This is known as theBuildings at Risk Register, which is periodicallyupdated and amended. In order to prevent thedeterioration of poorly maintained listedbuildings, the Local Planning Authority haspowers to serve a Notice to carry out urgentrepairs to an empty or partially occupiedbuilding, the cost of which can be recoveredfrom the owner. In severe cases, it can serve aRepairs Notice requiring the owners to carryout suitable repairs, following which, if thenotice is not complied with, it cancompulsorily purchase the building from theowners.Similarly, it is a criminal offence to carry outdemolition or works, which would requireConservation Area Consent, without havingobtained this.If it appears to the Secretary of State that thepreservation of an unoccupied building in aConservation Area is important for maintainingthe character or appearance of that Area, and ifits condition is a cause of concern, a Noticemay be served on the owner, to direct thaturgent works be undertaken to preserve thebuilding. If the owner then fails to comply withthe Notice, the <strong>District</strong> <strong>Council</strong> can instigatethe work itself, the costs of which can berecovered from the owner.Page - 42 -
