Cease persecut<strong>in</strong>g, prosecut<strong>in</strong>g, and punish<strong>in</strong>g<strong>North</strong> <strong>Korea</strong>ns repatriated by police authoritiesof neighbor<strong>in</strong>g countries. <strong>North</strong> <strong>Korea</strong>nsshould not be punished by their government <strong>for</strong>exercis<strong>in</strong>g their right to leave the DPRK.21. Observe the provisions of the DPRKCrim<strong>in</strong>al Code and Crim<strong>in</strong>al Procedures Codeon arrests, trials, and treatment of deta<strong>in</strong>edpersons—particularly prohibit<strong>in</strong>g the use oftorture or confessions obta<strong>in</strong>ed by the policeunder torture or <strong>for</strong>ced starvation <strong>in</strong> order tojustify the detention and imprisonment of <strong>North</strong><strong>Korea</strong>ns who crossed the DPRK-Ch<strong>in</strong>a border.<strong>The</strong> disregard by both <strong>North</strong> <strong>Korea</strong>n policeagencies of the DPRK’s own Crim<strong>in</strong>al Code andCrim<strong>in</strong>al Procedures Code should be ended.22. Ratify the Convention on the Elim<strong>in</strong>ationof All Forms of Racial Discrim<strong>in</strong>ation, andimmediately cease per<strong>for</strong>m<strong>in</strong>g <strong>in</strong>voluntaryabortions on pregnant repatriated women whoare suspected of hav<strong>in</strong>g ethnic Ch<strong>in</strong>ese spouses,and immediately end the practice of suffocat<strong>in</strong>gnew-born <strong>in</strong>fants or fetuses suspected of ethnicCh<strong>in</strong>ese fathers.24. Implement the key recommendations madeby other UN Member States dur<strong>in</strong>g the UniversalPeriodic Review at the UN <strong>Human</strong> <strong>Rights</strong>Council <strong>in</strong> 2009. Report to the Council on themeasures taken to implement the recommendationsthat the DPRK has acted upon.25. Ratify the Convention aga<strong>in</strong>st Torture andother <strong>for</strong>ms of Cruel, Inhuman and Degrad<strong>in</strong>gTreatment and Punishment, and implementthose standards, and all standards aga<strong>in</strong>sttorture and related practices <strong>in</strong> the InternationalCovenants and DPRK domestic legislation <strong>in</strong> allplaces of detention with<strong>in</strong> the DPRK.26. Initiate a dialogue with the UN HighCommissioner <strong>for</strong> <strong>Human</strong> <strong>Rights</strong>, and therelevant thematic UN rapporteurs and work<strong>in</strong>ggroups, <strong>in</strong>clud<strong>in</strong>g the Special Rapporteur on thesituation of human rights <strong>in</strong> the DPRK. Renewa human rights dialogue with the member statesof the European Union that have diplomaticrepresentation <strong>in</strong> Pyongyang. Invite the U.S.Special Envoy <strong>for</strong> <strong>North</strong> <strong>Korea</strong>n <strong>Human</strong> <strong>Rights</strong>Issues to Pyongyang <strong>for</strong> regular discussions ofhumanitarian and human rights issues.Regard<strong>in</strong>g International Standards andProcedures23. Implement the recommendations made tothe DPRK by the UN <strong>Human</strong> <strong>Rights</strong> <strong>Committee</strong>,the UN <strong>Committee</strong> on Economic, Socialand Cultural <strong>Rights</strong>, the <strong>Committee</strong> on the<strong>Rights</strong> of the Child and the <strong>Committee</strong> on theElim<strong>in</strong>ation of Discrim<strong>in</strong>ation Aga<strong>in</strong>st Women.II. Recommendations To thePeople’s Republic of Ch<strong>in</strong>a1. In accordance with recommendations madeto Ch<strong>in</strong>a by the UN <strong>Committee</strong> on the Elim<strong>in</strong>ationof Discrim<strong>in</strong>ation aga<strong>in</strong>st Women andthe UN <strong>Committee</strong> on the <strong>Rights</strong> of the Child,review the situation of <strong>North</strong> <strong>Korea</strong>n womenand asylum seekers to ensure that they do notbecome victims of traffick<strong>in</strong>g and marriageenslavement because of their status as illegal172
