Measures applied under the law anddesigned solely to protect the rights and specialstatus of women, especially pregnant womenand nurs<strong>in</strong>g mothers, children and juveniles,aged, sick or handicapped persons shall not bedeemed to be discrim<strong>in</strong>atory. <strong>The</strong> need <strong>for</strong>, andthe application of, such measures shall always besubject to review by a judicial or other authority.Pr<strong>in</strong>ciple 6No person under any <strong>for</strong>m of detention orimprisonment shall be subjected to tortureor to cruel, <strong>in</strong>human or degrad<strong>in</strong>g treatmentor punishment.* No circumstance whatevermay be <strong>in</strong>voked as a justification <strong>for</strong> torture orother cruel, <strong>in</strong>human or degrad<strong>in</strong>g treatment orpunishment.* <strong>The</strong> term “cruel, <strong>in</strong>human or degrad<strong>in</strong>gtreatment or punishment” should be <strong>in</strong>terpretedso as to extend the widest possible protectionaga<strong>in</strong>st abuses, whether physical or mental,<strong>in</strong>clud<strong>in</strong>g the hold<strong>in</strong>g of a deta<strong>in</strong>ed or imprisonedperson <strong>in</strong> conditions which deprive him,temporarily or permanently, of the use of any ofhis natural senses, such as sight or hear<strong>in</strong>g, or ofhis awareness of place and the pass<strong>in</strong>g of time.Pr<strong>in</strong>ciple 71. States should prohibit by law any act contraryto the rights and duties conta<strong>in</strong>ed <strong>in</strong> thesepr<strong>in</strong>ciples, make any such act subject to appropriatesanctions and conduct impartial <strong>in</strong>vestigationsupon compla<strong>in</strong>ts.2. Officials who have reason to believe that aviolation of this Body of Pr<strong>in</strong>ciples has occurredor is about to occur shall report the matter totheir superior authorities and, where necessary,to other appropriate authorities or organs vestedwith review<strong>in</strong>g or remedial powers.3. Any other person who has ground to believethat a violation of this Body of Pr<strong>in</strong>ciples hasoccurred or is about to occur shall have theright to report the matter to the superiors of theofficials <strong>in</strong>volved as well as to other appropriateauthorities or organs vested with review<strong>in</strong>g orremedial powers.Pr<strong>in</strong>ciple 8Persons <strong>in</strong> detention shall be subject to treatmentappropriate to their unconvicted status. Accord<strong>in</strong>gly,they shall, whenever possible, be keptseparate from imprisoned persons.Pr<strong>in</strong>ciple 9<strong>The</strong> authorities which arrest a person, keep himunder detention or <strong>in</strong>vestigate the case shallexercise only the powers granted to them underthe law and the exercise of these powers shall besubject to recourse to a judicial or other authority.Pr<strong>in</strong>ciple l0Anyone who is arrested shall be <strong>in</strong><strong>for</strong>med at thetime of his arrest of the reason <strong>for</strong> his arrestand shall be promptly <strong>in</strong><strong>for</strong>med of any chargesaga<strong>in</strong>st him.Pr<strong>in</strong>ciple ll1. A person shall not be kept <strong>in</strong> detention withoutbe<strong>in</strong>g given an effective opportunity to beheard promptly by a judicial or other authority.A deta<strong>in</strong>ed person shall have the right to defendhimself or to be assisted by counsel as prescribedby law.2. A deta<strong>in</strong>ed person and his counsel, if any,shall receive prompt and full communication ofany order of detention, together with the reasonsthere<strong>for</strong>e.191
