(1) No prisoner shall be punished except <strong>in</strong>accordance with the terms of such law or regulation,and never twice <strong>for</strong> the same offence.(2) No prisoner shall be punished unless he hasbeen <strong>in</strong><strong>for</strong>med of the offence alleged aga<strong>in</strong>st himand given a proper opportunity of present<strong>in</strong>g hisdefence. <strong>The</strong> competent authority shall conducta thorough exam<strong>in</strong>ation of the case.(3) Where necessary and practicable the prisonershall be allowed to make his defence throughan <strong>in</strong>terpreter.31. Corporal punishment, punishment by plac<strong>in</strong>g<strong>in</strong> a dark cell, and all cruel, <strong>in</strong>human or degrad<strong>in</strong>gpunishments shall be completely prohibitedas punishments <strong>for</strong> discipl<strong>in</strong>ary offences.32. (1) Punishment by close conf<strong>in</strong>ement orreduction of diet shall never be <strong>in</strong>flicted unlessthe medical officer has exam<strong>in</strong>ed the prisonerand certified <strong>in</strong> writ<strong>in</strong>g that he is fit to susta<strong>in</strong> it.(2) <strong>The</strong> same shall apply to any other punishmentthat may be prejudicial to the physical ormental health of a prisoner. In no case may suchpunishment be contrary to or depart from thepr<strong>in</strong>ciple stated <strong>in</strong> rule 31.(3) <strong>The</strong> medical officer shall visit daily prisonersundergo<strong>in</strong>g such punishments and shall advisethe director if he considers the term<strong>in</strong>ationor alteration of the punishment necessary ongrounds of physical or mental health.Instruments of Restra<strong>in</strong>t33. Instruments of restra<strong>in</strong>t, such as handcuffs,cha<strong>in</strong>s, irons and strait-jackets, shall never beapplied as a punishment. Furthermore, cha<strong>in</strong>s orirons shall not be used as restra<strong>in</strong>ts. Other <strong>in</strong>strumentsof restra<strong>in</strong>t shall not be used except <strong>in</strong> thefollow<strong>in</strong>g circumstances:( a ) As a precaution aga<strong>in</strong>st escape dur<strong>in</strong>g atransfer, provided that they shall be removedwhen the prisoner appears be<strong>for</strong>e a judicial oradm<strong>in</strong>istrative authority;( b ) On medical grounds by direction of themedical officer;( c ) By order of the director, if other methods ofcontrol fail, <strong>in</strong> order to prevent a prisoner from<strong>in</strong>jur<strong>in</strong>g himself or others or from damag<strong>in</strong>gproperty; <strong>in</strong> such <strong>in</strong>stances the director shall atonce consult the medical officer and report tothe higher adm<strong>in</strong>istrative authority.34. <strong>The</strong> patterns and manner of use of <strong>in</strong>strumentsof restra<strong>in</strong>t shall be decided by thecentral prison adm<strong>in</strong>istration. Such <strong>in</strong>strumentsmust not be applied <strong>for</strong> any longer time than isstrictly necessary.In<strong>for</strong>mation to and Compla<strong>in</strong>ts by Prisoners35. (1) Every prisoner on admission shall beprovided with written <strong>in</strong><strong>for</strong>mation about theregulations govern<strong>in</strong>g the treatment of prisonersof his category, the discipl<strong>in</strong>ary requirements ofthe <strong>in</strong>stitution, the authorized methods of seek<strong>in</strong>g<strong>in</strong><strong>for</strong>mation and mak<strong>in</strong>g compla<strong>in</strong>ts, and allsuch other matters as are necessary to enablehim to understand both his rights and his obligationsand to adapt himself to the life of the<strong>in</strong>stitution.(2) If a prisoner is illiterate, the a<strong>for</strong>esaid <strong>in</strong><strong>for</strong>mationshall be conveyed to him orally.36. (1) Every prisoner shall have the opportunityeach week day of mak<strong>in</strong>g requests or compla<strong>in</strong>tsto the director of the <strong>in</strong>stitution or the officerauthorized to represent him.(2) It shall be possible to make requests orcompla<strong>in</strong>ts to the <strong>in</strong>spector of prisons dur<strong>in</strong>g his<strong>in</strong>spection. <strong>The</strong> prisoner shall have the opportunityto talk to the <strong>in</strong>spector or to any other180
