這 是 我 任 內 發 表 的 第 四 份 年 報 。 回 顧
二 ○○ 七 年 , 本 署 經 歷 了 一 些 轉 變 ,
亦 面 對 不 少 挑 戰 。 現 把 其 中 一 些 重 點
簡 述 如 下 ..
This is my fourth Annual Report for the Legal Aid
Department. 2007 was a year which saw changes and
challenges for the Department. I would like to highlight
some of them here.

Re-organisation of Policy Bureaux of the
Government Secretariat
二 ○○ 七 年 七 月 一 日 , 制 訂 法 律 援 助 政
策 及 監 察 各 項 法 律 援 助 計 劃 運 作 的 職 務
改 由 民 政 事 務 局 負 責 。 把 上 述 原 屬 行 政
署 的 職 責 撥 歸 民 政 事 務 局 , 純 粹 是 因 為
當 局 重 新 分 配 政 府 總 部 轄 下 各 決 策 局 的
職 責 。 本 署 繼 續 根 據 《 法 律 援 助 條 例 》
賦 予 署 長 的 法 定 權 力 和 職 能 運 作 。 最 重
要 的 是 , 這 次 重 組 並 沒 有 影 響 本 署 在 提
供 法 律 援 助 方 面 一 貫 享 有 的 獨 立 性 。
On 1 July 2007, the Home Affairs Bureau took over
the responsibilities for formulating legal aid policy
and overseeing the implementation of the various
legal aid schemes from the Administration Wing. The
transfer was simply a re-distribution of responsibilities
within the Government Secretariat. The Department
continued to operate in accordance with the statutory
powers and function vested in the Director under the
Legal Aid Ordinance. What is most important is that
the re-organisation has not affected the established
independence of the Department in the delivery of legal
aid services.

Updated Study by ICAC on Enforcement
Procedures in the Department
廉 政 公 署 在 一 九 八 七 年 曾 應 法 律 援 助
署 署 長 所 請 , 就 本 署 執 行 小 組 ( 負 責 執
行 有 關 支 付 判 定 債 項 及 訟 費 的 判 決 )
的 工 作 進 行 研 究 。 二 ○○ 六 年 , 本 署
與 廉 政 公 署 議 定 , 該 署 會 按 最 新 情 況
研 究 及 檢 討 強 制 執 行 判 決 的 程 序 。 廉
政 公 署 於 二 ○○ 七 年 六 月 完 成 最 新 報
告 。
In 1987, the Independent Commission Against Corruption
(“ICAC”) conducted a study at the request of the Director
of Legal Aid on the work of the Enforcement Unit which
is responsible for enforcing the payment of judgment
debts and legal costs. In 2006 it was agreed between the
Department and the ICAC that the study on enforcement
procedures should be updated and reviewed. The ICAC’s
updated report was finalised in June 2007.
