nystagmus is both dist<strong>in</strong>ct and susta<strong>in</strong>ed. If<br />

the eyes are held <strong>in</strong> that position for a lesser<br />

amount of time, the officer may see nystagmus,<br />

but he cannot say that it was dist<strong>in</strong>ct<br />

(very obvious) and that it was susta<strong>in</strong>ed<br />

(last<strong>in</strong>g). Thus hold<strong>in</strong>g the eye <strong>in</strong> the maximum<br />

deviation position for a m<strong>in</strong>imum of<br />

4 seconds is essential.<br />

F<strong>in</strong>ally, if the officer fails to complete two<br />

passes and only does one pass, then he has<br />

no opportunity to rule out a false positive.<br />

The purpose of the second pass is to ensure<br />

that what the officer th<strong>in</strong>ks he observed<br />

<strong>in</strong> the eyes on the first pass is really there<br />

by confirm<strong>in</strong>g it on the second pass. For<br />

<strong>in</strong>stance, let’s say on the first pass the officer<br />

believed he observed dist<strong>in</strong>ct and susta<strong>in</strong>ed<br />

nystagmus at maximum deviation present<br />

<strong>in</strong> the right eye. On the second pass he<br />

should be able to confirm the dist<strong>in</strong>ct and<br />

susta<strong>in</strong>ed nystagmus at maximum deviation<br />

<strong>in</strong> the eyes. If he does not, then it’s not to<br />

be counted as a clue. Thus the second pass<br />

is essential!<br />

clue of the Horizontal Gaze Nystagmus test<br />

- onset of nystagmus prior to 45 degrees.<br />

performance,” he said. So elderly should<br />

have plenty of time to socialize. It not only<br />

will help with memory, but also depression<br />
