Understand<strong>in</strong>g the<br />

The unofficial yet elegant and simple guide to<br />

gender awareness.<br />

Gender today is def<strong>in</strong>ed as A social cultural<br />

and personal construct. We have<br />

moved away from b<strong>in</strong>ary def<strong>in</strong>itions<br />

and it is not a biological construct; separate<br />

from the sex-based categories of<br />

male/female.<br />

But its not really about gender is it? Its<br />

about how you th<strong>in</strong>k and act. The lack<br />

of understand<strong>in</strong>g that creates bully<strong>in</strong>g<br />

and can be verbal, physical, or via<br />

the Internet. It can severely affect the<br />

victim’s self-image, social <strong>in</strong>teractions,<br />

and often leads to <strong>in</strong>security, lack of<br />

self-esteem, and depression. Who <strong>in</strong><br />

their right m<strong>in</strong>d would be happy to see<br />

others suffer? Probably those that suffer<br />

the most. maybe some <strong>in</strong> the LGBT<br />

community felt it happen to them and<br />

now they do it to others. We have many<br />

bullies all around us. I see it on face<br />

book, constant jabs and creat<strong>in</strong>g social<br />

clicks that exclude rather the <strong>in</strong>clude.<br />

People even use their friends to trick<br />

them <strong>in</strong>to bully<strong>in</strong>g others. Some times<br />

its just <strong>in</strong>tentional. We may be crazy<br />

but really we are all we have, we should<br />

make life better not harder for others.<br />

The <strong>in</strong>formation that your eyes feed<br />

back to the bra<strong>in</strong> must to be understood<br />

by the bra<strong>in</strong>,<br />

While the bra<strong>in</strong> is quite clever at<br />

sometimes this difference can be quite<br />

astound<strong>in</strong>g.<br />

Roy Smith - Award W<strong>in</strong>n<strong>in</strong>g Figure Artist-<br />

Egon Schiele was the topic of last <strong>week</strong>s<br />

article. He was an emerg<strong>in</strong>g Austrian artist<br />

at the turn of the century <strong>in</strong> early 1900.<br />

Today his work is be<strong>in</strong>g revised and recognized<br />

for its unique expressionism. It is<br />

be<strong>in</strong>g used <strong>in</strong> publications and orig<strong>in</strong>als are<br />

be<strong>in</strong>g collected and exhibited <strong>in</strong> galleries<br />

and museums. Roy Smith who is be<strong>in</strong>g featured<br />

<strong>in</strong> this <strong>week</strong>s article has been <strong>in</strong>spired<br />

by Egon Schiele’s work.<br />

Roy Smith the other half of Smith-Vargas<br />

Gallery is also an accomplished figure<br />

artist. He <strong>in</strong>dicates that much of his <strong>in</strong>spiration<br />

is derived from the work of Schiele.<br />

Roys own work was a w<strong>in</strong>n<strong>in</strong>g entry <strong>in</strong> the<br />

Tom of F<strong>in</strong>land, Erotic Art Contest. <strong>This</strong><br />

year Roy is a featured artist <strong>in</strong> the ART of<br />

MAN. <strong>This</strong> is an annually published work<br />

on art of the male body. Egon Schiele is<br />

a historically featured artist <strong>in</strong> this same<br />

issue.<br />

Roy grew up <strong>in</strong> northern Wiscons<strong>in</strong> and<br />

attended the University of M<strong>in</strong>nesota. He<br />

jo<strong>in</strong>ed the Air Force and was stationed <strong>in</strong><br />

Germany. His <strong>in</strong>terest was not <strong>in</strong> art dur<strong>in</strong>g<br />

these early years. It was not until his sister<br />

demonstrated her talent with watercolor<br />

that his <strong>in</strong>terest <strong>in</strong> draw<strong>in</strong>g and pa<strong>in</strong>t<strong>in</strong>g<br />

sparked.<br />

He has lived and worked <strong>in</strong> Los Angeles for<br />

several years with his now deceased partner.<br />

He draws nearly everyday of the <strong>week</strong><br />

<strong>in</strong> his studio and at LACMA (Los Angles<br />

County Museum of Art). Roy’s work with<br />

the human figure is executed <strong>in</strong> a variety of<br />

media, <strong>in</strong>clud<strong>in</strong>g, pastel, watercolor, acrylic,<br />

<strong>in</strong>k and pencil. The figures are either<br />

seated or recl<strong>in</strong><strong>in</strong>g, nude and clothed. The<br />

contours of the figures are expressive and<br />

def<strong>in</strong>itive. Here is where the <strong>in</strong>fluence of<br />

Egon Schiele is noted. As you view his<br />

work, the sense of his knowledge of the human<br />

anatomy is appreciated. He <strong>in</strong>cludes<br />

detailed design <strong>in</strong> textiles and furniture<br />

with <strong>in</strong>k and color, sometimes add<strong>in</strong>g gold<br />

leaf to embellish the details. <strong>This</strong> contrasts<br />

with the more delicate figures to create the<br />

unique<br />

quality of Roy’s work.<br />

LGBT Heroes Bayard Rust<strong>in</strong> (1912-1987)<br />

Bayard Rust<strong>in</strong> was a leader <strong>in</strong> civil rights<br />

movement of the 20th century. In 1947<br />

he planned the first Freedom Ride, which<br />

challenged segregation on <strong>in</strong>terstate bus systems<br />

and <strong>in</strong>spired further such rides <strong>in</strong> the<br />

1960s. Rust<strong>in</strong> comb<strong>in</strong>ed his organizational<br />

skills with support for nonviolent resistance<br />

and became a key adviser to Mart<strong>in</strong> Luther<br />

K<strong>in</strong>g Jr. He was often arrested for his stances<br />

and spent two years <strong>in</strong> prison for refus<strong>in</strong>g<br />

to register for the draft. Widely known as<br />

gay to his contemporaries, Rust<strong>in</strong> was also<br />

jailed for homosexual activity <strong>in</strong> 1953 and<br />

often attacked as a “pervert” by his political<br />

opponents.<br />

The Anatomy of a DUI<br />

An Overview of Alcohol<br />

<strong>in</strong>struct the subject to follow the stimulus<br />

with his eyes only, not mov<strong>in</strong>g his head.<br />

Check<strong>in</strong>g the left eye first, the officer is<br />

tra<strong>in</strong>ed to slowly move the stimulus towards<br />

the right at a speed that would take approximately<br />

four seconds for the stimulus to<br />

reach the edge of the subject’s shoulder. The<br />

officer is tra<strong>in</strong>ed to watch the eye carefully<br />

for any sign of jerk<strong>in</strong>g to beg<strong>in</strong>. When the<br />

officer observes the jerk<strong>in</strong>g beg<strong>in</strong>, he should<br />

stop the movement, verify that the jerk<strong>in</strong>g<br />

cont<strong>in</strong>ues, and note the position where the<br />

jerk<strong>in</strong>g began (what degree po<strong>in</strong>t). The<br />

officer will then move the stimulus to the<br />

left (to check subject’s right eye) aga<strong>in</strong> at a<br />

speed that would take approximately four<br />

seconds for the stimulus to reach the edge of<br />

the subject’s shoulder, and aga<strong>in</strong> watch the<br />

eye carefully for any sign of jerk<strong>in</strong>g to beg<strong>in</strong>.<br />

When the officer sees the jerk<strong>in</strong>g beg<strong>in</strong>, the<br />

officer should stop, verify that the jerk<strong>in</strong>g<br />

cont<strong>in</strong>ues, and note the position where he<br />

observed the jerk<strong>in</strong>g beg<strong>in</strong> (what degree<br />

po<strong>in</strong>t). <strong>This</strong> procedure is repeated for a total<br />

of two passes for each eye for this part of the<br />

test.<br />

If the po<strong>in</strong>t at which the jerk<strong>in</strong>g beg<strong>in</strong>s is<br />

prior to 45 degrees (between 0 degrees and<br />

the 45 degree po<strong>in</strong>t), then the officer can<br />

score it as a clue. Remember, if the center of<br />

the face is 0 degrees and the tip of the shoulder<br />

is 90 degrees, then 45 degrees will be <strong>in</strong><br />

between those two po<strong>in</strong>ts on an arc (aga<strong>in</strong><br />

th<strong>in</strong>k of a protractor).<br />

If the po<strong>in</strong>t at which the jerk<strong>in</strong>g beg<strong>in</strong>s is<br />

either at 45 degrees or after the 45 degree<br />

po<strong>in</strong>t (between 45 degrees and the 90 degree<br />

In the last article I discussed procedures<br />

relat<strong>in</strong>g to the first two clues of the Horizontal<br />

Gaze Nystagmus (HGN) test – Lack of<br />

Smooth Pursuit and Dist<strong>in</strong>ct and Susta<strong>in</strong>ed<br />

Nystagmus at Maximum Deviation. In this<br />

article I will cont<strong>in</strong>ue the discussion with<br />

the procedures for the third clue – “Onset of<br />

Nystagmus Prior to 45 Degrees.”<br />

The third clue, “onset of nystagmus prior to<br />

45 degrees, is the po<strong>in</strong>t at which the eye is<br />

first observed to beg<strong>in</strong> jerk<strong>in</strong>g. It is alleged<br />

by the research studies that if the jerk<strong>in</strong>g<br />

beg<strong>in</strong>s prior to 45 degrees it is a clue that the<br />

person has a blood alcohol concentration<br />

of 0.08% or above. It is believed that the<br />

higher the amount of alcohol <strong>in</strong> the subject’s<br />

system, the sooner the nystagmus will be<br />

observable.<br />

Where is 45degrees you might ask? Beg<strong>in</strong>n<strong>in</strong>g<br />

with the stimulus properly positioned<br />

at the center of the subject’s nose, this<br />

position is considered 0 degrees. The tip of<br />

the subject’s shoulder would be 90 degrees.<br />

Thus 45 degrees would be <strong>in</strong> between those<br />

po<strong>in</strong>ts (th<strong>in</strong>k of a protractor).<br />

To perform this part of the test (clue #3), the<br />

officer beg<strong>in</strong>s with the stimulus positioned<br />

at the center of the subject’s face with stimulus<br />

positioned 12 to 15 <strong>in</strong>ches away from<br />

the subject’s nose. The officer is tra<strong>in</strong>ed to po<strong>in</strong>t), then the officer should not score it as<br />

a clue as this mean noth<strong>in</strong>g as many people<br />

will exhibit nystagmus at or after the 45<br />

degree po<strong>in</strong>t, even with hav<strong>in</strong>g no alcohol <strong>in</strong><br />

their system. <strong>This</strong> is why when observ<strong>in</strong>g if<br />

a subject has nystagmus at maximum deviation<br />

(clue #2 discussed <strong>in</strong> my last article) it<br />

is essential to make sure that the nystagmus<br />

is dist<strong>in</strong>ct and susta<strong>in</strong>ed for a m<strong>in</strong>imum of<br />

4 seconds. Many alcohol free persons may<br />

have it for 1 or 2 seconds.<br />

Also the tim<strong>in</strong>g is aga<strong>in</strong> important when<br />

conduct<strong>in</strong>g this part of the test. The speed<br />

of mov<strong>in</strong>g the stimulus slowly - the rate<br />

of 4 seconds from center of face to tip of<br />

shoulder - is important because studies have<br />

shown that if the officer moves the stimulus<br />

too fast, the officer will actually <strong>in</strong>duce or<br />

cause the nystagmus to occur. If the officer<br />

causes the nystagmus by mov<strong>in</strong>g the<br />

stimulus too fast, any conclusions from his<br />

observations (that the nystagmus is caused<br />

by alcohol or drugs <strong>in</strong> the body) is compromised.<br />

In addition, it is essential that the officer<br />

perform two complete passes for each eye as<br />

the second pass allows the officer to confirm<br />

what he saw on the first pass to elim<strong>in</strong>ate the<br />

possibility of a false positive.<br />

superior is sad. I feel sad for YOU. You are<br />

pathetic and I guess that’s why you need<br />

to knock people down. Some people are<br />

scratch<strong>in</strong>g their heads wonder<strong>in</strong>g what I<br />

am talk<strong>in</strong>g about, so I guess that makes<br />

you one of those people. Why do you care<br />

what I am do<strong>in</strong>g? Concentrate on yourself<br />

and you won’t need to be a destructive,<br />
