Note: This method should only really be used if the immediate<br />
dissolution <strong>of</strong> the estate is necessary. If it can wait until the child is<br />
delivered, then that is the better option. However, if any or the<br />
deceased’s heirs die before the estate is distributed, they will still be<br />
counted among the heirs and their share will be added to their estate.<br />
HERMAPHRODITES/ANDROGYNES<br />
On condition that the gender <strong>of</strong> the hermaphrodite cannot be<br />
established, or one gender cannot be deemed as given precedence<br />
over the other, then the allotment <strong>of</strong> the hermaphrodite is that <strong>of</strong> its<br />
female counterparts. This is the ruling given by Im\m Ab[ *an|fah and<br />
many <strong>of</strong> the %a#\bah.This is the general ruling given.<br />

MAFQ$D - A MISSING PERSON<br />
Being missing in the terminology <strong>of</strong> the Shar|`ah is that a person’s<br />
whereabouts are not known and there is no news as to the state <strong>of</strong> the<br />
missing person, i.e. is he/she dead, alive, settled, lost, captive, etc. Due<br />
to the uncertain nature <strong>of</strong> the person being alive or dead, it is difficult<br />
to give any general rule as to what to do. If a person gives a ruling <strong>of</strong> his<br />
