The fund failed to deliver the<br />

Government’s stated intention<br />

of immediate financial<br />

assistance for those who were<br />

put into severe financial duress,<br />

because of Minister Allan’s<br />

decisions. Only 20% of those<br />

who could apply to the Fairness<br />

Fund did so.<br />

This was because of the lack of<br />

confidence in the management<br />

of the fund and the complexity<br />

of the application.<br />

New management for the<br />

Fairness Fund should be<br />

appointed.<br />

This might restore<br />

the confidence of the<br />

industry.<br />

Also, an independent review<br />

should be done immediately,<br />

recommendations made and<br />

the Fairness Fund should<br />

be reopened to the industry<br />

urgently.<br />

The Victorian Ombudsman<br />

is currently investigating the<br />

roll-out of this unfair fund.<br />

We have asked the Victorian<br />

Ombudsman, Ms Glass, to<br />

widen the scope of the enquiry<br />

to all aspects of this Unfairness<br />

fund.<br />

The inconsistency of payments,<br />

what was the criteria? There<br />

was no transparency or even a<br />

right of appeal.<br />

We have also asked Ms Glass to<br />

investigate the role of the TSC<br />

in the Commercial Passenger<br />

Vehicle Industry reforms. The<br />

taxi and hire car industry have<br />

no confidence in the TSC, and<br />

nor should the public.<br />

The public expects law<br />

(legislation) to be enforced.<br />

The TSC chose not to enforce<br />

legislation against an American<br />

multi-national, but actively<br />

enforced legislation against the<br />

local industry.<br />

We have a right to<br />

be protected by law<br />

from those who<br />

break it.<br />

The TSC deliberately turned<br />

a blind eye and failed in<br />

its obligations to enforce<br />

legislation, failing the taxi<br />

and hire car industry, and the<br />

travelling public who use these<br />

services.<br />

The Taxi Services Commission<br />

needs to be transparent and<br />

explain its decisions. This is<br />

imperative to restore industry<br />

and public confidence in the<br />

regulator the Taxi Services<br />

Commission.<br />
