Fampodiana
Le Fampodiana est une étape de la vie conjugale où
après une séparation, l’homme invite son épouse à
réintégrer le domicile. La notion est enseignée en
cours de droit coutumier, vu sa dimension légale et
son importance traditionnelle.
Chez les Malgaches, la remise de la dot aux parents de
la fille marque le début du mariage ; avant cette cérémonie
l’union est considérée comme du concubinage.
Renforcement de l’union ?
Si la femme a ses prérogatives qu’est le droit de Misintaka
(se retirer), l’homme jouit du Fampodiana. La femme
peut quitter temporairement le domicile conjugal pour
des motifs graves jusqu’à ce que le mari procède aux
démarches du Fampodiana prévues par l’Institution.
Historiquement, cette faculté a été donnée à l’épouse
malheureuse en ménage qui se retire alors chez ses
parents et attend les meilleurs sentiments d’un mari
repentant. Le droit est ensuite étendu à l’ensemble des
femmes.
Ainsi, les traditions matrimoniales valorisent les
parents : fondation du foyer, rupture du mariage comme
réconciliation. Durant le Fampodiana, le mari et sa famille
proche procèdent à la donation de zébus ou à un don
d’argent aux parents de la femme.
Il est possible qu’une tentative n’aboutisse pas pour
diverses raisons : soit la famille, soit la femme ellemême
s’y opposent. Le chef du village peut être amené
à intervenir. Le succès du Fampodiana repose sur sa
sagesse. Toutefois, en l’absence de parents biologiques du
mari, la nullité du Fampodiana est prononcée.
The Fampodiana is a stage in marriage, where
after a separation the man invites his wife to
return home. This concept is part of the rules
set by customary law, giving it a legal dimension
and a traditional relevance.
Among the Malagasy, the handing over of the dowry
to the parents of the girl marks the beginning of the
marriage – before this ceremony the union was considered
a concubinage.
Strengthening the union?
While the woman’s prerogative is the right of Misintaka (to
withdraw), the man is entitled to conduct a Fampodiana.
The wife may temporarily leave the marital home on
serious reasons, until the husband initiates the proceedings
of the Fampodiana as intended by the Customs. Historically,
this option has been open to the unhappy married wife
who then retires to her parents' home and awaits the
best feelings of a repentant husband. The customary law
extended this right to all women.
As a result, the matrimonial traditions enhance the role
of the parents: the household as foundation, reconciliation
after marriage breakdown. During Fampodiana, the
husband and his immediate family donate zebus or donate
money to the woman's parents.
It is possible that an attempt does not succeed for various
reasons: either the family or the woman herself oppose
it. Then the village chief may have to intervene and the
success of the Fampodiana relies on his wisdom. However,
after the demise of the husband’s biological parents his
possibility of Fampodiana has ceased as well.
