Employment<br />

In October, the Supreme Court heard<br />

arguments in multiple cases that could have<br />

far-reaching consequences for LGBTQ<br />

people:<br />

Zarda v Altitude Express – a case on behalf<br />

of Don Zarda, a late skydiving instructor<br />

who was fired because he was gay – and<br />

EEOC v. RG & GR Harris Funeral Homes<br />

– a case on behalf of Aimee Stephens, a<br />

transgender woman who was fired when<br />

she informed her boss that she intended<br />

to transition. These cases could determine<br />

once and for all if the Civil Rights Act<br />

of 1964 protects LGBTQ people in the<br />

workplace. Title VII of the Civil Rights Act<br />

prohibits discrimination because of sex,<br />

which should necessarily include sexual<br />

orientation and gender identity. We expect<br />

to receive a decision before the end of this<br />

Supreme Court term.<br />

Public Accommodations<br />

Last week, the Oregon Court of Appeals<br />

heard oral arguments for the second time in<br />

Klein dba Sweetcakes by Melissa v. Oregon<br />

Bureau of Labor and Industries, the case of<br />

a Portland-area bakery that denied service<br />

to a lesbian couple based on religious<br />

objections. Two years ago, this same court<br />

upheld a favorable decision in this case<br />

from a state agency in 20<strong>15</strong>, but the U.S.<br />

Supreme Court ordered it to reconsider its<br />

prior ruling in light of the 2018 Masterpiece<br />

<strong>Ca</strong>keshop v. Colorado Civil Rights<br />

Commission decision. This is just one of a<br />

slew of similar lawsuits playing out across<br />

the country involving the weaponization<br />

of religion to discriminate against LGBTQ<br />

people.<br />

Adoption & Foster <strong>Ca</strong>re<br />

Litigation is ongoing in two lawsuits<br />

against the federal government for allowing<br />

taxpayer money to fund foster care agencies<br />

that discriminate against LGBTQ parents.<br />

In Marouf v. Azar, a same-sex couple from<br />

Texas was denied the opportunity even to<br />

apply to serve as foster parents for refugee<br />

children because, as they were told, they<br />

did not “mirror the Holy Family.” In Rogers<br />

v. United States Department of Health<br />

and Human Services, a married lesbian<br />

couple was turned away by a governmentfunded<br />

foster care agency that excludes<br />

prospective foster parents who are not<br />

evangelical Protestant Christian or who are<br />

same-sex couples of any faith. At least eight<br />

additional states have passed laws allowing<br />

providers to use a religious litmus test for<br />

whom they serve, and some state laws even<br />

allow taxpayer-funded providers to give<br />

“religious education” to children. More<br />

harmful bills have already been introduced<br />

this year, and the Tennessee legislature even<br />

devastatingly passed one yesterday.<br />

HIV+ Military Service<br />

Last week, in an important victory, the<br />

Fourth Circuit Court of Appeals upheld<br />

a lower court ruling in Roe & Voe v.<br />

Three presidents of the United States have<br />

been impeached, Andrew Johnson, a<br />

successor to Abraham Lincoln, Richard<br />

Nixon, for obstruction of justice and<br />

subsequently resigned before being removed<br />

from office. William Clinton was impeached<br />

but not removed from office. The most recent<br />

and current president, Donald Trump was<br />

impeached by the House of Representatives<br />

in December of 2019.<br />

The artist who painted the portrait of<br />

Andrew Johnson was Washington Bogart<br />

Cooper a Tennessee artist who painted a<br />

large number of portraits during his career.<br />

Only one president but several governors'<br />

portraits. Johnson was impeached for the<br />

charge of failing to receive congressional<br />

approval for the firing of an appointed<br />

official. This came about from his strong<br />

belief that the South should be welcomed<br />

back to the Union after the Civil War. After<br />

firing the Secretary of War, Edwind Stanton<br />

from his cabinet, Johnson was brought up on<br />

charges of violating the Tenure of Office act.<br />

He was not convicted but the harm inflicted<br />

by the impeachment was fatal and caused<br />

him to lose the reelection.<br />

William Clinton was impeached in 1998<br />

with the charges of lying under oath from<br />

a sexual relationship with a White House<br />

intern, Monica Lewinsky. The obstruction of<br />

Justice charge was derived from attempting<br />

to lie regarding the sexual encounter. The<br />

official portrait of Bill Clinton was painted<br />

by Nelson Shanks. Shanks said he included<br />

a shadow over the fireplace behind Clinton<br />

in the portrait, the shadow being cast from<br />

a blue dress that was worn by Monica<br />

Lewinsky. Shanks said, "He (referring to<br />

Clinton) is probably the most famous liar<br />

of all time" This is the reason he gave for<br />

including the shadow into the painting.<br />

Now we come to our current president,<br />

Donald J. Trump, who has topped the<br />

statement by artist Sharks regarding Clinton<br />

being the most famous liar of all times.<br />

The count is now <strong>15</strong>,435 and counting,<br />

presidency. He was impeached for the chargers<br />

of Abuse of Power and Osbruction of Congress.<br />

The charges could have been far more numerous<br />

against Trump. It was the decision of the<br />

House Judiciary Committee and Speaker Nancy<br />

Pelosi, to limit the charges, which in some<br />

way incorporate other charges that could have<br />

been brought, following the Mueller Report,<br />

which included several indications of charges,<br />

including collusion with an enemy power as part<br />

of the Foreign Corrupt Practices Act, <strong>Ca</strong>mpain<br />

Finance Laws, Bribery, etc. etc.<br />

There has not been an official portrait of Trump<br />

painted. His administration passed a law that<br />

says that government funds may not be used to<br />

paint portraits of government officials, including<br />

the president. This is admittedly a semi-positive<br />

act, limiting the use of government funds,<br />

however, it also smacks of the lack of support the<br />

Trump administration has given to the arts in<br />

general. Most people would certainly approve<br />

of Donald Trump not having an official portrait<br />

painted with government funds. There is a<br />

portrait of Trump included in this article that<br />

might be an appropriate depiction of Trump and<br />

his corruption as president.<br />

Donald Trump will most surely be known in<br />

history as the most deserving of impeachment<br />

and removal from office, however, the trial that<br />

remains to be held in the Senate has not been<br />

held because the articles of impeachment have<br />

not been sent to the senate the by Speaker of the<br />

House, Nancy Pelosi. The facts of the need for<br />

removal from office are obvious. The unusual<br />

situation of the support of a majority of one<br />

political party for criminally corrupt president<br />

and his total administration is unprecedented in<br />

United States history and detrimental to the rule<br />

of law and democracy. Hopefully, artists in all<br />

areas of the arts as well as journalists and others<br />

will continue to expose the corruption of Donald<br />

J. Trump and his corrupt administration so that<br />

it will not continue beyond the damage it has<br />

already inflicted on the country.<br />
