10. Read the following passage and answer the questions given
below :
The forerunners of Savigny, notably, Schelling and Hugo
had rejected the natural law theory that assumed that law
was based on an abstract principle of human reason. They
supported the view that law was a historical perception
which evolved through traditions, customs, and sentiments
of the people. Savigny was tha main exponent of the
historical interpretation of law. He propounded the concept
of historical jurisprudence. He traced the development of
law as an evolutionary process much before Charles
Darwin came out with his theory of biological evolution.
That is why, Savigny was described as 'Darwinian before
Darwin' for his contribution of applying the evolutionary
principle to the legal system. Savigny's theory of law
evoked mixed reaction as it motivated the colonized
communities and nations to struggle against foreign
domination. It sought to encourage fascism in Italy and
