Intergenerational Planning

– These words mean many

things to many people, and this

is probably the most diverse

area of planning where I am

regularly asked to assist. The

baby boomers have undoubtedly

made asset wealth on property

and some may have inherited or generated wealth.

However, the questions they ask are “Will we run out of

money“ – “Can we pass our wealth to our offspring”.

Initially, simple planning such as Wills* and Lasting

Powers of Attorney, of which there are two – Health

& Welfare and Property and Financial affairs is the

starting point. I work with fellow professionals where

necessary to create these structures.

Every person has circumstances which are different,

which is why it is critical a full discussion takes

place. Following that start point, it is a matter of

understanding what you are trying to achieve with

all that you have, and then create a bespoke plan

that is flexible to meet any changing circumstances

i.e. cover home fees whilst protecting the estate,

having access to capital and protecting the estate.

Inheritance tax you choose to pay if you don’t use all

of the opportunities to mitigate it. Allowances such

as nil rate bands, Resident Nil rate Bands and annual

exemptions which are sufficient for most people to

achieve their outcomes.

Where more complex situations arise, I will look

to include any number of the following: PETS over

7 years and structures that are effective after 2

years, Business relief, Trusts, Gifting, Loan Trusts,

Discounted Gift Trusts, Charitable donations, Rysaffe

structures, Protection, Tenants in Common, Pensions

and annual exemptions. Increasingly we see changes

to Gifts with reservation and Deprivation of assets

legislation, but with careful planning and flexible

arrangements you can have your cake and eat it

ensuring that taxation is not the largest inheritor of

your estate, but your family are.
