5. <strong>The</strong> <strong>Court</strong> may enter bilateral arrangements with States with a view to<br />

establishing a framework <strong>for</strong> the acceptance of prisoners sentenced by the <strong>Court</strong>.<br />

Such arrangements shall be consistent with the Statute.<br />

Rule 201<br />

Principles of equitable distribution<br />

Principles of equitable distribution <strong>for</strong> purposes of article 103, paragraph 3,<br />

shall include:<br />

(a) <strong>The</strong> principle of equitable geographical distribution;<br />

(b) <strong>The</strong> need to af<strong>for</strong>d each State on the list an opportunity to receive sentenced<br />

persons;<br />

(c) <strong>The</strong> number of sentenced persons already received by that State and other<br />

States of en<strong>for</strong>cement;<br />

(d) <strong>An</strong>y other relevant factors.<br />

Rule 202<br />

Timing of delivery of the sentenced person to the State of en<strong>for</strong>cement<br />

<strong>The</strong> delivery of a sentenced person from the <strong>Court</strong> to the designated State of<br />

en<strong>for</strong>cement shall not take place unless the decision on the conviction and the<br />

decision on the sentence have become final.<br />

Rule 203<br />

Views of the sentenced person<br />

1. <strong>The</strong> Presidency shall give notice in writing to the sentenced person that it<br />

is addressing the designation of a State of en<strong>for</strong>cement. <strong>The</strong> sentenced person<br />

shall, within such time limit as the Presidency shall prescribe, submit in writing<br />

his or her views on the question to the Presidency.<br />

2. <strong>The</strong> Presidency may allow the sentenced person to make oral representations.<br />

3. <strong>The</strong> Presidency shall allow the sentenced person:<br />

(a) <strong>To</strong> be assisted, as appropriate, by a competent interpreter and to benefit<br />

from any translation necessary <strong>for</strong> the presentation of his or her views;<br />

(b) <strong>To</strong> be granted adequate time and facilities necessary to prepare <strong>for</strong> the<br />

presentation of his or her views.
