En este sentido, el Tribunal penal ad hoc para la ex Yugoslavia<br />
señaló que, a diferencia de la generalidad de las normas internacionales,<br />
la implementación constituye parte integral de la obligación<br />
internacional de no torturar porque de otra manera la prohibición<br />
no resultaría efectiva. De ahí su afirmación, en el caso Furundžija:<br />
“Another facet of the same legal effect must be emphasized. Normally,<br />
the maintenance or passage of national legislation inconsistent<br />
with international rules generates State responsibility and consequently<br />
gives rise to a corresponding claim for cessation and reparation<br />
(lato sensu) only when such legislation is concretely applied.<br />
By contrast, in the case of torture, the mere fact of keeping in force<br />
or passing legislation contrary to the international prohibition of<br />
torture generates international State responsibility. The value of<br />
freedom from torture is so great that it becomes imperative to preclude<br />
any national legislative act authorizing or condoning torture or at any rate<br />
capable of bringing about this effect” (la cursiva es nuestra). 5<br />
Esta misma idea es la que llevó a la Corte Interamericana de <strong>Derecho</strong>s<br />
Humanos a afirmar que una ley de amnistía peruana “carecía<br />
de efectos jurídicos” porque no podía seguir representando un obstáculo<br />
para la investigación, identificación y castigo de los responsables<br />
de graves violaciones a los derechos humanos. Así señaló:<br />
“41. Esta Corte considera que son inadmisibles las disposiciones<br />
de amnistía, las disposiciones de prescripción y el establecimiento<br />
