Conditions générales <strong>de</strong> vente <strong>de</strong>s prestations <strong>de</strong> l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong><br />

Terms and Conditions<br />

Les conditions générales <strong>de</strong> vente définies ci-après s’appliquent à l’ensemble<br />

<strong>de</strong>s prestations <strong>de</strong> l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> vendues par contrat.<br />

Ces conditions définissent les droits et obligations <strong>de</strong> l’<strong>Office</strong> <strong>de</strong> Tourisme<br />

<strong>de</strong> <strong>Versailles</strong> et <strong>de</strong> son client. À ce titre, l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong><br />

qui offre à un client <strong>de</strong>s prestations est l’unique interlocuteur <strong>de</strong> ce<br />

client et répond <strong>de</strong>vant lui <strong>de</strong> l’exécution <strong>de</strong>s obligations découlant <strong>de</strong>s<br />

présentes conditions <strong>de</strong> vente.<br />

Toute condition particulière <strong>de</strong> vente stipulée dans le contrat<br />

entre l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> et le client prévaut sur<br />

ces conditions générales <strong>de</strong> vente.<br />

1. Droits et obligations <strong>de</strong> l’acheteur<br />

11. Réservation<br />

Toute réservation implique l’acceptation <strong>de</strong>s « conditions générales<br />

<strong>de</strong> vente » et prend effet à la réception du courrier <strong>de</strong> confirmation<br />

accompagné <strong>de</strong> son acompte égal à 50 % du montant total TTC <strong>de</strong>s<br />

prestations qui, sauf cas particulier et dûment stipulé, ne comprend aucun<br />

frais <strong>de</strong> transport.<br />

12. Paiement <strong>de</strong>s prestations<br />

Le client s’engage à régler le sol<strong>de</strong> du montant <strong>de</strong> la prestation définie<br />

par contrat 30 jours avant le début <strong>de</strong> ladite prestation, par l’un<br />

<strong>de</strong>s moyens suivants : Espèces, Chèque, Carte bancaire ou Virement.<br />

Le client sera réputé avoir annulé sa réservation si ce sol<strong>de</strong> n’est pas acquis<br />

30 jours avant le début <strong>de</strong> ladite prestation et l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong><br />

<strong>Versailles</strong> sera réputé délié <strong>de</strong> tout engagement vis à vis <strong>de</strong> son client<br />

ou <strong>de</strong> tout tiers qui pourrait lui être opposé.<br />

Dans le cadre <strong>de</strong>s circuits, le client doit impérativement communiquer<br />

à l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> le nombre exact et définitif<br />

<strong>de</strong> participants, et ceci trente (30) jours avant l’arrivée du groupe.<br />

Passé ce délai, l’<strong>Office</strong> <strong>de</strong> Tourisme ne tiendra plus compte <strong>de</strong>s<br />

désistements éventuels et ne sera tenu à aucun remboursement<br />

<strong>de</strong> trop perçu.<br />

Pour toute réservation faite moins <strong>de</strong> 30 jours avant le début <strong>de</strong><br />

la prestation, la totalité du règlement sera exigée.<br />

Par ailleurs, le client s’engage à régler sur place ou à réception <strong>de</strong> facture<br />

après prestation tout supplément non prévu initialement.<br />

13. Modifications <strong>de</strong> prestations<br />

Toute <strong>de</strong>man<strong>de</strong> <strong>de</strong> modification <strong>de</strong> prestation <strong>de</strong> la part du client doit<br />

être notifiée par courrier recommandé avec accusé <strong>de</strong> réception adressé<br />

à l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong>.<br />

Si, moins <strong>de</strong> 30 jours, avant la date prévue du début <strong>de</strong> la prestation,<br />

l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> se trouve contraint d’apporter une ou<br />

<strong>de</strong>s modifications au contrat, le client peut :<br />

– soit résilier son contrat et obtenir le remboursement immédiat<br />

<strong>de</strong>s sommes versées,<br />

– soit accepter la modification.<br />

Un avenant précise alors celle(s)-ci et doit être signé par les <strong>de</strong>ux parties.<br />

Toute diminution <strong>de</strong> prix vient en déduction <strong>de</strong>s sommes restant<br />

éventuellement dues par le client et, si le paiement déjà effectué par<br />

ce <strong>de</strong>rnier excè<strong>de</strong> le prix <strong>de</strong> la prestation modifiée, le trop perçu sera<br />

restitué au client.<br />

14. Autre obligation<br />

Le client signataire du présent contrat, conclu pour une durée ou une date<br />

déterminée, ne pourra en aucune circonstance et pour quelle raison que<br />

ce soit, se prévaloir d’un quelconque droit <strong>de</strong> maintien dans les lieux<br />

à l’issue <strong>de</strong> la prestation.<br />

2. Droits et obligations<br />

<strong>de</strong> l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong><br />

21. Annulation <strong>de</strong> prestations du fait du client<br />

Toute annulation du fait du client entraîne les retenues suivantes :<br />

– Plus <strong>de</strong> 60 jours avant la date <strong>de</strong> la prestation : remboursement intégral<br />

<strong>de</strong> l’acompte versé<br />

– <strong>de</strong> 60 à 30 jours avant la date <strong>de</strong> la prestation : remboursement <strong>de</strong> 50 %<br />

<strong>de</strong> l’acompte versé.<br />

– moins <strong>de</strong> 30 jours avant la date <strong>de</strong> la prestation : le montant <strong>de</strong><br />

la prestation versé reste acquis à l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong>.<br />

22. Modifications <strong>de</strong> prestations<br />

Lorsqu’en cours <strong>de</strong> prestation, l’<strong>Office</strong> <strong>de</strong> Tourisme se trouve dans<br />

l’impossibilité <strong>de</strong> fournir une part <strong>de</strong>s prestations prévues au contrat,<br />

l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> proposera une prestation en<br />

remplacement <strong>de</strong> la prestation prévue, en supportant éventuellement<br />

tout supplément <strong>de</strong> prix.<br />

Si la prestation acceptée par le client est d’un coût inférieur, l’office<br />

<strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> lui remboursera la différence <strong>de</strong> prix.<br />

3. Autres conditions<br />

31. Horaires<br />

En cours <strong>de</strong> voyage, le bon déroulement <strong>de</strong> la ou <strong>de</strong>s journées exige <strong>de</strong><br />

respecter les horaires indiqués au programme ou par le gui<strong>de</strong> conférencier.<br />

En cas <strong>de</strong> retard du groupe, les visites seront en fonction <strong>de</strong> la disponibilité<br />

du gui<strong>de</strong> conférencier écourtées ou prolongées, et dans ce cas,<br />

la prestation majorée.<br />

En cas <strong>de</strong> retard non signalé, le gui<strong>de</strong> conférencier n’est pas tenu<br />

d’attendre le groupe plus <strong>de</strong> 30 minutes.<br />

En ce qui concerne le retour, les heures indicatives figurant sur<br />

les programmes sont basées sur <strong>de</strong>s conditions <strong>de</strong> trafic normal.<br />

L’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> dégage toute responsabilité sur<br />

un éventuel retard. En cas <strong>de</strong> non présentation ou <strong>de</strong> retard, il ne sera<br />

procédé à aucun remboursement.<br />

32. Effets personnels<br />

Dans le cadre <strong>de</strong>s circuits touristiques, l’<strong>Office</strong> <strong>de</strong> Tourisme recomman<strong>de</strong><br />

à chaque participant <strong>de</strong> veiller sur ses effets personnels et <strong>de</strong> ne rien<br />

oublier dans les véhicules <strong>de</strong> transport (siège ou filet).<br />

En aucun cas, l’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> ne pourra être tenu pour<br />

responsable <strong>de</strong> la perte ou du vol <strong>de</strong>s objets laissés à bord <strong>de</strong>s véhicules.<br />

4. Responsabilités <strong>de</strong> l’<strong>Office</strong> <strong>de</strong> Tourisme<br />

<strong>de</strong> <strong>Versailles</strong><br />

L’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> ne peut être tenu pour responsable<br />

<strong>de</strong>s cas fortuits (notamment <strong>de</strong>s conditions météorologiques), <strong>de</strong>s cas<br />

<strong>de</strong> force majeure ou du fait <strong>de</strong> toute personne étrangère à l’organisation<br />

et au déroulement <strong>de</strong> la prestation.<br />

41. Responsabilité Civile Professionnelle<br />

L’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> a souscrit auprès <strong>de</strong> la Société<br />

GAN, représentée par l’Agence <strong>Versailles</strong> Centre au 10 rue André<br />

Chénier - 78000 <strong>Versailles</strong>, un contrat d’assurance Responsabilité Civile<br />

Professionnelle n o 979.104.950 du 15 juin 1994, en application <strong>de</strong> l’article<br />

n o 31 <strong>de</strong> la Loi n o 92.645 du 13 juillet 1992.<br />

42. Garantie Financière<br />

L’<strong>Office</strong> <strong>de</strong> Tourisme <strong>de</strong> <strong>Versailles</strong> dispose <strong>de</strong> sa garantie financière auprès<br />

<strong>de</strong> la Banque Populaire Val <strong>de</strong> France au 9 avenue Newton – 78183<br />

St Quentin en Yvelines, conformément aux dispositions <strong>de</strong>s articles 51<br />

et suivants du décret n° 94.490 du 15 juin 1994.<br />

5. Litiges<br />

Toute réclamation relative à une prestation doit être soumise à l’<strong>Office</strong> <strong>de</strong><br />

Tourisme <strong>de</strong> <strong>Versailles</strong> dans les 8 jours à compter <strong>de</strong> la date <strong>de</strong> prestation<br />

par lettre recommandée adressée à l’<strong>Office</strong> <strong>de</strong> <strong>tourisme</strong> <strong>de</strong> <strong>Versailles</strong>.<br />

Les conditions d’exercice <strong>de</strong>s activités relatives à l’organisation et à la vente<br />

<strong>de</strong>s voyages ou séjours sont fixées par la loi du 13 juillet 1992 (JO du 17<br />

juin 1994).<br />

Tout litige portant sur l’application <strong>de</strong>s présentes conditions générales <strong>de</strong> vente<br />

sera <strong>de</strong> la compétence exclusive du Tribunal <strong>de</strong> Gran<strong>de</strong> Instance <strong>de</strong> <strong>Versailles</strong>.<br />

The general conditions of sale <strong>de</strong>fined below apply to the whole of<br />

the services of the Tourist <strong>Office</strong> of <strong>Versailles</strong> sold by contract.<br />

These conditions <strong>de</strong>fine the rights and obligations of the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong> and its customer. For this reason, the Tourist <strong>Office</strong> of<br />

<strong>Versailles</strong> which offers to a customer services is the single interlocutor<br />

of this customer and answers in front of him of the execution of the<br />

obligations rising from these conditions of sale.<br />

Any particular condition of sale stipulated in the contract between<br />

the Tourist <strong>Office</strong> of <strong>Versailles</strong> and the customer prevails on these<br />

general conditions of sale.<br />

1. Rights and obligations of the purchaser<br />

11. Reservation<br />

Any reservation implies the acceptance of the “general conditions of<br />

sale” and takes effect with the reception of the mail of confirmation<br />

accompanied by its installment equal to 50% by total amount including<br />

all taxes by the services which, except particular case and duly stipulated,<br />

does not inclu<strong>de</strong>/un<strong>de</strong>rstand any transport charges.<br />

12. Payment of the services<br />

The customer commits himself regulating the balance of the amount<br />

of the service <strong>de</strong>fined by contract 30 days before the beginning of the<br />

aforesaid the service, by one of the average following: Species, Cheque,<br />

Bank card or Transfer.<br />

The customer will be consi<strong>de</strong>red to have cancelled his reservation if this<br />

balance is not acquired 30 days before the beginning of the aforesaid<br />

the service and the Tourist <strong>Office</strong> of <strong>Versailles</strong> will be consi<strong>de</strong>red untied<br />

of any engagement with respect to its customer or any third which could<br />

be opposite for him.<br />

Within the framework of the circuits, the customer must imperatively<br />

communicate to the Tourist <strong>Office</strong> of <strong>Versailles</strong> the exact and final number<br />

of participants, and this thirty (30) days before the arrival of the group.<br />

At the end of this period, the Tourist <strong>Office</strong> will not hold any more account<br />

of possible <strong>de</strong>sistance and will be held with no refunding of too perceived.<br />

For any reservation ma<strong>de</strong> less than 30 days before the beginning of<br />

the service, the totality of the payment will be required.<br />

By elsewhere, the customer commits himself regulating on the spot or with<br />

reception of invoice after service any supplement not envisaged initially.<br />

13. Modifications of services<br />

Any request for modification of service on behalf of the customer must<br />

be notified by mail recommen<strong>de</strong>d with acknowledgement of <strong>de</strong>livery<br />

addressed to the Tourist <strong>Office</strong> of <strong>Versailles</strong>.<br />

If, less than 30 days, before the date envisaged of the beginning of<br />

the service, the Tourist <strong>Office</strong> of <strong>Versailles</strong> is constrained to bring one<br />

or of the modifications to the contract, the customer can:<br />

– that is to say to terminate its contract and to obtain the immediate<br />

refunding of the paid sums,<br />

– that is to say to accept the modification.<br />

An endorsement specifies that then (S) here and must be signed<br />

by the two parts.<br />

Any reduction in price comes in <strong>de</strong>duction from the sums remaining<br />

possibly had by the customer and, if the payment already carried out<br />

by this last exceeds the price of the modified service, too perceived will<br />

be restored with the customer.<br />

14. Another obligation<br />

The customer signatory of this contract, conclu<strong>de</strong>d for one duration or<br />

a <strong>de</strong>termined date, will be able in no circumstance and for which reason<br />

that it is, to prevail itself of any right of maintenance in the places at<br />

the end of the service.<br />

2. Rights and obligations of the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong><br />

21. Cancellation of services because of the customer<br />

Any cancellation because of the customer involves following reserves:<br />

– More than 60 days before the date of the service: full repayment<br />

of the versed installment<br />

– from 60 to 30 days before the date of the service: refunding of 50%<br />

of the versed installment.<br />

– less than 30 days before the date of the service: the versed amount<br />

of the service remain<strong>de</strong>r acquired with the Tourist <strong>Office</strong> of <strong>Versailles</strong>.<br />

22. Modifications of services<br />

When in course of service, the <strong>Office</strong> of Tourism is unable to provi<strong>de</strong><br />

a share of the services envisaged to the contract, the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong> will propose a service to replace the service envisaged,<br />

by possibly supporting any additional charge.<br />

If the service accepted by the customer is of a lower cost, the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong> will refund the difference in price to him.<br />

3. Other conditions<br />

31. Schedules<br />

In course of voyage, the good unfolding days requires to respect<br />

the schedules indicated to the program or by the gui<strong>de</strong> lecturer.<br />

In case of <strong>de</strong>lay of the group, the visits according to the availability<br />

of the gui<strong>de</strong> lecturer curtailed or will be prolonged, and in this case,<br />

the raised service.<br />

In case of <strong>de</strong>lay not announced, the gui<strong>de</strong> lecturer is not held to await<br />

the group more than 30 minutes.<br />

With regard to the return, the indicative hours being reproduced on<br />

the programs are based on conditions of normal traffic.<br />

The Tourist <strong>Office</strong> of <strong>Versailles</strong> releases any responsibility on a possible<br />

<strong>de</strong>lay. In the event of non presentation or of <strong>de</strong>lay, will not be carried out<br />

to any refunding.<br />

32. Personal effects<br />

Within the framework of the tourist tours, the <strong>Office</strong> of Tourism<br />

recommends to each participant to take care on his personal effects<br />

and nothing to forget in the freight vehicles (seat or net).<br />

In any case, the Tourist <strong>Office</strong> of <strong>Versailles</strong> could be held for person<br />

in charge for the loss or the flight of the left objects aboard vehicles.<br />

4. Responsibilities for the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong><br />

The Tourist <strong>Office</strong> of <strong>Versailles</strong> cannot be held for person in charge<br />

for the fortuitous occurences (in particular of the weather conditions),<br />

for the case of absolute necessity or because of any foreign person with<br />

the organization and the course of the service.<br />

41. Professional Civil liability<br />

The Tourist <strong>Office</strong> of <strong>Versailles</strong> subscribed near Company GAN, represented<br />

by the Agency <strong>Versailles</strong> Centre with 10 rue André Chénier – 78000<br />

<strong>Versailles</strong>, a contract of insurance Professional Civil Liability n°979.104.950<br />

for June 15, 1994, pursuant to the article n°31 of the Law n°92.645<br />

of July 13 1992.<br />

42. Financial guarantee<br />

The Tourist <strong>Office</strong> of <strong>Versailles</strong> lays out of its financial guarantee near the<br />

Popular Bank Valley of France with 9 avenue Newton – 78183 St Quentin<br />

in Yvelines, in accordance with the provisions of articles 51 and following<br />

of the <strong>de</strong>cree n° 94.490 of June 15, 1994.<br />

5. Litigations<br />

Any complaint relating to a service must be subjected to the Tourist <strong>Office</strong><br />

of <strong>Versailles</strong> in the 8 days as from the date of service per registered letter<br />

addressed to the Tourist <strong>Office</strong> of <strong>Versailles</strong>.<br />

The conditions of exercise of the activities relating to the organization<br />

and the sale of the voyages or stays are fixed by the law of July 13, 1992<br />

(OJ of June 17 1994).<br />

Any bearing litigation on the application of these general conditions of<br />

sale will be exclusive competence of the Court of Bankruptcy of <strong>Versailles</strong>.<br />
