TheCourt of Arbitration for Sport Project is formally presented to the Department of Justice, as anew organization at disposal of every sports agent, which is expected to become a simplifiedmean to solve conflicts and ensure the Right through a quick, agile and economic relationshipwithin the sports family.The core of the question is a simple equation: you either assume that everything in thepublic service must be ensured by the State, or consider in the other hand that State’smission is to grant the existence of quality and useful public services, that can be doneby contract by private organizations by delegation of competences on recognized institutions.So, the great job done by those who accepted the challenge of being part of the InstallingCommission of Portuguese Court of Arbitration for Sport, led by Judge Cardoso da Costa,deserves applause.The conclusion of CAS was only made possible by Government’s reformist vision, especiallyon behalf of the New Law of Physical Activity and Sports, through which the Justiceon Sports may now be seen in a State free perspective, considering the incoherence ofthe previous legal set-up. It’s nice to say, loud and clear, that’s the only way to restorehalf-dozen of lost years.These records do configure a political sign and an encouragement message for the future,as it shows that the N.O.C. of Portugal has a program and is executing it beyond its capacities,honoring its compromises. C.O.P has a strategic line of thinking, values to defendand a well structured dynamic for work, priority’s oriented. That is why results show upand are such a delight for us.We are aware that the path isn’t an easy one and doesn’t please everybody. But we areconvinced of always speaking the true, never denying the dialogue and always demandingrespect and loyalty.There are no powers that may undermine our decision and evaluation mechanisms, as weconsider with legitimacy that’s what allowing us to turn one more page in the Portuguesesports organization.5Outubro|Dezembro 2007
