Anpassung der Richtlinien für nichtselbsttätige
Waagen und für Messgeräte
an die Europäischen Rahmenbedingungen
Im Beschluss 768/2008/EG haben das Europäische
Parlament und der Rat den bestehenden
Rechtsrahmen für die Vermarktung von Produkten
überarbeitet und neu festgelegt. Der
Beschluss enthält Musterregelungen für
• Begriffsbestimmungen und allgemeine
Verantwortlichkeiten der Wirtschaftsakteure
• Anforderungen an Benannte Stellen und
Notifizierungsverfahren
• Konformitätsbewertungsverfahren
• CE-Kennzeichnung
• Schutzklauselverfahren (Verfahren bei
technischer und formaler Nichtkonformität).
Alle bestehenden Richtlinien nach dem neuen
Ansatz (New Legal Framework – NLF) werden
entsprechend dieses Beschlusses angepasst
(Omnibus-Verfahren). Dabei geht es nicht nur
um redaktionelle, sondern auch um materielle
Änderungen. Insgesamt werden die Regelungen
deutlich klarer und damit verbindlicher.
Die Anpassungsvorschläge für die Richtlinien
2009/23/EG (nichtselbsttätige Waagen) und
2004/22/EG (Messgeräte) wurden im Messgeräteausschuss
der Kommission diskutiert und
abgestimmt, bevor die neuen Textentwürfe
dem Parlament und dem Rat zur Zustimmung
vorgestellt werden. Wesentlichstes Ergebnis
der durchgeführten Arbeiten ist die weitestgehende
Annäherung der beiden Richtlinien. Die
Verabschiedung der überarbeiteten Richtlinien
wird bis Mitte des nächsten Jahres erwartet.
Überprüfung der europäischen Messgeräterichtlinie
sowie die eventuelle Rücknahme
von EWG-Richtlinien zu Messgeräten
Laut Artikel 25 der europäischen Messgeräterichtlinie
(MID, 2004/22/EG) soll die Europäische
Kommission bis Ende April 2011 über die
bisherigen Erfahrungen mit der MID Bericht
erstatten. Sie soll berichten, ob die Konformitätsbewertungsverfahren
ordnungsgemäß angewendet
werden und ob ggf. Änderungen
zur einheitlichen Zertifizierung vorzuschlagen
sind. Deutschland (BMWi und PTB) hat sich

conditions
In Decision 768/2008/EC, the European Parliament
and the Council have revised and recast
the existing framework for the marketing of
products. The decision provides reference provisions
for
• definitions and general obligations for
economic operators
• requirements placed on notified bodies
and notification procedures
• conformity assessment procedures
• CE marking
• safeguard clause procedures (procedures
for technical and formal non-compliance).
All existing directives according to the new
approach (New Legal Framework – NLF) will
be adapted according to this decision (omnibus
procedure). Here, not only editorial, but
also material changes will be made. All in all,
the regulations will become considerably clearer
and – thus – more binding. The adaptation
proposals for the Directives 2009/23/EC
and 2004/22/EC were discussed and agreed
upon in the Measuring Instruments Committee
of the Commission and the new drafts
will now be presented to the Parliament and
Council for approval. Approval of the revised
Directives is expected for the middle of
next year.
Assessment and revision of the MID as
well as a possible withdrawal of the still
existing EEC directives
According to article 25 of the MID, the Commission
is to report on the realisation of the
MID by the end of April 2011. It is to report on
whether the conformity assessment procedures
are properly applied, and whether modifications
for the uniform certification are to be proposed,
where applicable. Germany (PTB and
BMWi – Federal Ministry of Economics) has
participated actively in the enquiries made by
the Commission and its commissioned company
“Centre for Strategy & Evaluation Services”
(CSES) and has also submitted proposals of its
own. A particular role is – due to its European
composition and acceptance – assumed by
WELMEC and its Working Committees. These
