materials that have well recognised rehabilitat<strong>in</strong>g, preventive or cur<strong>in</strong>g properties. <strong>Herbal</strong><br />

remedies are def<strong>in</strong>ed as those <strong>products</strong> manufactured with a s<strong>in</strong>gle part of a <strong>medic<strong>in</strong>al</strong><br />

plant, or a comb<strong>in</strong>ation of its parts that have been used for <strong>the</strong> relief of certa<strong>in</strong> symptoms<br />

based on popular or traditional knowledge. <strong>Herbal</strong> <strong>products</strong> <strong>in</strong> ei<strong>the</strong>r category should not be<br />

comb<strong>in</strong>ed with narcotics, psychotropics, chemical active <strong>in</strong>gredients, allopathic <strong>products</strong>,<br />

human or animal hormones or <strong>products</strong> that have an anti-hormonal or hormonal activity.<br />

Injectable presentations shall not be classified as herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong>.<br />

<strong>Herbal</strong> tea <strong>products</strong>, such as camomile, are not classified as <strong>medic<strong>in</strong>al</strong> <strong>products</strong>. In<br />

addition, <strong>the</strong>re are vegetal extracts such as Cnidoscolos chayamansa, Sabila, Cuachalalate,<br />

etc., which are presented <strong>in</strong> a pharmaceutical form and are not registered as herbal<br />

<strong>medic<strong>in</strong>al</strong> <strong>products</strong> but are still considered as food supplements. This situation is ma<strong>in</strong>ly<br />

expla<strong>in</strong>ed by <strong>the</strong> fact that it was not until 1995 that <strong>the</strong> M<strong>in</strong>istry of Health streng<strong>the</strong>ned its<br />

classification criteria and started request<strong>in</strong>g herbal <strong>medic<strong>in</strong>al</strong> product manufacturers to<br />

register <strong>the</strong>ir <strong>products</strong> as <strong>medic<strong>in</strong>al</strong> <strong>products</strong>. Before 1995, all of <strong>the</strong>se <strong>products</strong> could be<br />

registered as food supplements.<br />

In accordance with <strong>the</strong> General Health Law, <strong>medic<strong>in</strong>al</strong> <strong>products</strong> are firstly def<strong>in</strong>ed by<br />

function and secondly by presentation. That means that a <strong>medic<strong>in</strong>al</strong> product should have<br />

rehabilitat<strong>in</strong>g, preventive or cur<strong>in</strong>g properties and be presented <strong>in</strong> a pharmaceutical form.<br />

b ) Is <strong>the</strong>re a specific category for herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong> that have no<br />

<strong>the</strong>rapeutic claim?<br />

All <strong>products</strong> legally registered as herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong> may make claims i n<br />

accordance with <strong>the</strong> authorisation issued by <strong>the</strong> M<strong>in</strong>istry of Health. <strong>Herbal</strong> remedies may<br />

make symptomatic claims not<strong>in</strong>g that such effects are based on <strong>the</strong>ir traditional use. As<br />

mentioned above, <strong>the</strong>re are also some <strong>products</strong> conta<strong>in</strong><strong>in</strong>g herbal extracts that are still<br />

mak<strong>in</strong>g unauthorised claims.<br />

c ) Is <strong>the</strong>re a specific category for herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong> conta<strong>in</strong><strong>in</strong>g wellknown<br />

plants?<br />

Yes, <strong>the</strong> herbal <strong>medic<strong>in</strong>al</strong> category.<br />

d) Is <strong>the</strong>re a specific category for traditionally used herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong><br />

(e.g., <strong>in</strong> <strong>the</strong> treatment of certa<strong>in</strong> <strong>in</strong>dications)?<br />

Yes, <strong>the</strong> herbal remedies category.<br />

e ) Are <strong>the</strong>re “comb<strong>in</strong>ation <strong>products</strong>” on <strong>the</strong> market, <strong>in</strong>clud<strong>in</strong>g comb<strong>in</strong>ations with<br />

homeopathics, food supplements, vitam<strong>in</strong>s, am<strong>in</strong>o acids, etc.? How do <strong>the</strong><br />

authorities assess <strong>the</strong>se <strong>products</strong>?<br />

Currently, <strong>the</strong>re are <strong>products</strong> that comb<strong>in</strong>e herbals, vitam<strong>in</strong>s and m<strong>in</strong>erals only. These<br />

<strong>products</strong> may be considered food supplements provided that none of <strong>the</strong>ir vitam<strong>in</strong> or m<strong>in</strong>eral<br />

concentrations exceed <strong>the</strong> lower limits established for non-prescription vitam<strong>in</strong>s or<br />

m<strong>in</strong>erals. M<strong>in</strong>istry of Health assesses <strong>the</strong>se <strong>products</strong> as any o<strong>the</strong>r <strong>medic<strong>in</strong>al</strong> comb<strong>in</strong>ation<br />

<strong>products</strong>, look<strong>in</strong>g at each component’s <strong>the</strong>rapeutic activity and <strong>the</strong> possibility for it to cause<br />

synergistic, antagonistic or add<strong>in</strong>g effects.<br />

f ) Are <strong>the</strong>re modern herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong> on <strong>the</strong> market that have been<br />

fur<strong>the</strong>r developed from <strong>the</strong>ir traditional use (e.g., highly processed, new <strong>in</strong>dications,<br />

new pharmaceutical form, etc.)? Are <strong>the</strong>re herbal <strong>medic<strong>in</strong>al</strong> <strong>products</strong> approved<br />

and sold as OTC drugs?<br />

There is one product made out of camomile that is presented <strong>in</strong> o<strong>in</strong>tment and solution. Its<br />

name is Camilosan and it is manufactured by a national pharmaceutical company.<br />

Ano<strong>the</strong>r product is made out of Garc<strong>in</strong>ia cambogia and classified as a prescription for weight<br />

reduction.<br />
