Accord<strong>in</strong>g to <strong>the</strong> Agency Instructions No. 3, <strong>the</strong>re should be only two possibilities:<br />
— The drug is <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> positive list. An abridged application may be submitted<br />
with <strong>the</strong> <strong>the</strong>rapeutic <strong>in</strong>dication “Traditionally used <strong>in</strong> …”. However, <strong>the</strong>re is an<br />
exemption for laxatives, for which <strong>the</strong> laxative nature of <strong>the</strong> <strong>medic<strong>in</strong>al</strong> product and its<br />
<strong>in</strong>dication, i.e. constipation, must be clearly stated. Indications such as “purgative” or<br />
“for slimm<strong>in</strong>g purposes” etc. are not accepted.<br />
— The drug is not <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> positive list. There is no simplification <strong>in</strong> <strong>the</strong><br />
requirements for proof of efficacy (and <strong>the</strong>refore no option to use an abridged<br />
procedure).<br />
Traditional <strong>the</strong>rapeutic <strong>in</strong>dications for herbal drugs reported <strong>in</strong> Annex II to Agency<br />
Instructions No. 3 have been selected based on a careful review of all available literature,<br />
<strong>in</strong>clud<strong>in</strong>g chemical composition and pharmacological, toxicological and cl<strong>in</strong>ical data. The<br />
number of <strong>the</strong>rapeutic <strong>in</strong>dications allowed for a herbal <strong>medic<strong>in</strong>al</strong> product has usually been<br />
limited to two; <strong>the</strong>y are chosen by <strong>the</strong> applicant from <strong>the</strong> list of <strong>in</strong>dications for <strong>the</strong> active<br />
pr<strong>in</strong>ciple. When two <strong>in</strong>dications are chosen for a comb<strong>in</strong>ation of several active pr<strong>in</strong>ciples,<br />
<strong>the</strong>y should belong to <strong>the</strong> same <strong>the</strong>rapeutic category.<br />
