City, when maintenance is transferred to the City. The City reserves the right to
remove or require the removal of landscaping in excess of the landscaping
required by the Subdivision Regulation Ordinance No. 94-08-19, as it currently
exists or may be amended (i.e. flower beds or 'other vegetation considered as
high maintenance by the City).
D. Landscaping and Fencing for Cul-de-sacs
1. Landscaping Requirements. Where cul-de-sacs are located adjacent to a
street right-of-way such that the cul-de-sac lot(s) side to an adjacent street,
the developer shall install landscaping within the side yard of the lot(s)
abutting the street as follows:
a. Three-inch (3 1') caliper trees shall be planted twenty-five feet (25') oncenter
(or a total of seven (7) trees) within the area seventy-five feet
(75') in both directions from the projected centerline of the cul-de-sac.
[See Exhibit #4 of 7.09(16) attached hereto and incorporated herein for
all purposes] If trees are required for screening along the adjacent
street, the trees shall be credited towards the number of trees required
for screening of the adjacent street. The trees shall not count towards -
the number of trees required by the Comprehensive Zoning Ordinance
No. 93-07-11, as it currently exists or may be amended, for residential
lots.
b. Shrubs shall be three feet (3') in height and planted ten feet (10') oncenter
within the same area for the trees. A solid living screen is not
required.
c. The developer shall provide total maintenance for the landscaping for a
minimum of three (3) years, or until the houses on the affected lots are
sold for occupancy (the "maintenance period"). At the end of the
maintenance period, an inspection will be conducted by the City. All
landscaping shall be in a healthy and growing condition, as determined
by the City, when maintenance is transferred to the City. The City
reserves the right to remove or require the removal of landscaping in
excess of the landscaping required by the Subdivision Regulation
Ordinance No. 94-08-19, as it currently exists or may be amended (i.e.
flower beds or other vegetation considered as high maintenance by the
City).
2. Screening Wall and Fencing Requirements. Where cul-de-sacs are located
adjacent to a street right-of-way such that the cul-de-sac lot(s) side to an
adjacent street, the developer shall install fencing as follows:
a. No screening wall is required when a cul-de-sac lot sides to an adjacent
street.
b. When a cul-de-sac abuts and cul-de-sac lots side to a street with a rightof-way
width of sixty (60) feet or greater, an ornamental metal fence of
four feet (4') to eight feet (8') in height shall be constructed on the rightof-way
line of the adjacent street. The fence height shall not exceed the
height of a connecting screening wall. A sidewalk shall be constructed to
