No sanitary sewer, water, or storm sewer pipe shall be covered without approval of the Director of
City Services, or his representative. No concrete shall be poured for streets, structures, or curbs
and gutters without said approval. No flexible base material shall be placed on the street subgrade,
or asphaltic surface applied to the flexible base of a street without said approval. All inspection fees
to be paid by the developer and/or the contractor are covered under Ordinance No. 93-04-05.
After completion of all improvements, franchise utilities, grading, and erosion control, the City
Engineer, Director of City Services, Chief Building Inspector, and other designated representatives
will perform a final inspection before recommending acceptance by the City Council.
7.14 PENALTY
Any person violating this Ordinance or any portion thereof shall upon conviction be guilty of a
misdemeanor and shall be fined any sum not exceeding $ 1,000 and each day that such violation
continues shall be considered a separate offense and punishable accordingly.
7.15 APPEAL (Z99-14; Ordinance No. 99-09-25)
a. An appeal for relief from the regulations set forth in Section 7.08 may be made to and
shall be considered by the City Council.
b. Any appeal must be submitted in writing to the City Council with submission of a
preliminary plat. The appeal, at a minimum, shall specifically.identify the regulation
complained of, the relief requested, and the evidence to support the relief requested.
c. The owner/applicant has the burden of proof to establish by clear and convincing
evidence that a proposed regulation set forth in Section 7.08 does not meet
constitutional guarantees and/or statutory requirements.
d. If the owner/applicant meets its burden of proof, the City Council shall have the right to
grant relief from the regulations set forth in Section 7.08.
