In <strong>20</strong>06, the Italian Parliament strengthened the enforcement powers <strong>of</strong> the <strong>Competition</strong><br />

Authority, br<strong>in</strong>g<strong>in</strong>g them <strong>in</strong> l<strong>in</strong>e with the new powers now enjoyed by the European<br />

Commission follow<strong>in</strong>g the so-called “modernization” <strong>of</strong> EU competition <strong>law</strong>. 12 More<br />

specifically, Section 14(1) <strong>of</strong> Decree <strong>Law</strong> No. 223/<strong>20</strong>06 (the Reform Package) 13<br />

granted the<br />

<strong>Competition</strong> Authority the power to: (i) order <strong>in</strong>terim measures, (ii) accept commitments<br />

proposed by companies <strong>in</strong>volved <strong>in</strong> an <strong>in</strong>vestigation <strong>in</strong>to anticompetitive <strong>practice</strong>s, <strong>and</strong> (iii)<br />

operate a leniency program.<br />

(a) Interim Measures<br />

<strong>The</strong> new Section 14-bis <strong>of</strong> the <strong>Competition</strong> <strong>Law</strong> states that <strong>in</strong> urgent cases where (i)<br />

there is a risk <strong>of</strong> serious <strong>and</strong> irreparable damage to competition <strong>and</strong> (ii) a cursory<br />

exam<strong>in</strong>ation reveals the existence <strong>of</strong> an <strong>in</strong>fr<strong>in</strong>gement, the <strong>Competition</strong> Authority may decide<br />

on its own motion that <strong>in</strong>terim measures must be adopted. In contrast to the “modernized”<br />

enforcement system <strong>in</strong>troduced with Regulation (EC) No. 1/<strong>20</strong>03, <strong>in</strong>terim measures may not<br />

be renewed or extended <strong>in</strong> their duration. If the addressee <strong>of</strong> the <strong>in</strong>terim measures does not<br />

comply with the decision, the <strong>Competition</strong> Authority may impose a f<strong>in</strong>e <strong>of</strong> up to three<br />

percent <strong>of</strong> the annual consolidated turnover <strong>of</strong> the undertak<strong>in</strong>g concerned.<br />

(b) Commitments<br />

<strong>The</strong> new Section 14-ter <strong>of</strong> the <strong>Competition</strong> <strong>Law</strong> <strong>in</strong>troduces the possibility for<br />

companies to <strong>of</strong>fer commitments <strong>in</strong> the context <strong>of</strong> antitrust <strong>in</strong>vestigations. <strong>The</strong>y can do so<br />

with<strong>in</strong> three months from the open<strong>in</strong>g <strong>of</strong> an <strong>in</strong>vestigation. <strong>The</strong> commitments should aim at<br />

correct<strong>in</strong>g the conduct under <strong>in</strong>vestigation. After assess<strong>in</strong>g the suitability <strong>of</strong> such<br />

commitments, <strong>in</strong>clud<strong>in</strong>g by means <strong>of</strong> a market test, the <strong>Competition</strong> Authority may make<br />

them b<strong>in</strong>d<strong>in</strong>g on the undertak<strong>in</strong>gs concerned <strong>and</strong> term<strong>in</strong>ate the proceed<strong>in</strong>gs without<br />

ascerta<strong>in</strong><strong>in</strong>g any <strong>in</strong>fr<strong>in</strong>gement. <strong>The</strong> commitment decisions do not set f<strong>in</strong>es because they do<br />

not conta<strong>in</strong> f<strong>in</strong>d<strong>in</strong>gs on the merits. 14<br />

Commitment decisions have become a frequently used enforcement tool, <strong>and</strong> the<br />

<strong>Competition</strong> Authority has now closed several cases by accept<strong>in</strong>g commitments, mostly <strong>in</strong><br />

14 Prior to this amendment, there was great uncerta<strong>in</strong>ty about the possibility for undertak<strong>in</strong>gs to <strong>of</strong>fer<br />

commitments with a view to clos<strong>in</strong>g an <strong>in</strong>vestigation <strong>in</strong>to alleged anticompetitive <strong>practice</strong>s. In<br />

particular, s<strong>in</strong>ce it was not clear on which basis the <strong>Competition</strong> Authority could accept<br />

commitments without complet<strong>in</strong>g the <strong>in</strong>vestigation with a f<strong>in</strong>d<strong>in</strong>g on the merits, the <strong>Competition</strong><br />

Authority had no obligation to exam<strong>in</strong>e commitments that were <strong>of</strong>fered by the undertak<strong>in</strong>gs<br />

concerned. In addition, the adoption <strong>of</strong> commitments did not result <strong>in</strong> any shorten<strong>in</strong>g <strong>of</strong> the duration<br />

<strong>of</strong> the proceed<strong>in</strong>gs as – even if commitments were accepted – under the then applicable rules<br />

govern<strong>in</strong>g adm<strong>in</strong>istrative proceed<strong>in</strong>gs the <strong>Competition</strong> Authority had to cont<strong>in</strong>ue its assessment <strong>of</strong><br />

the allegedly illegal behavior <strong>and</strong> come to a f<strong>in</strong>al decision on the merits before clos<strong>in</strong>g the case.<br />
