liabilities <strong>and</strong> f<strong>in</strong>es would be circumvented altogether. 79<br />
2. Cartel Enforcement<br />
<strong>The</strong> <strong>Competition</strong> Authority is among the most active national competition <strong>law</strong><br />
enforcement agencies <strong>in</strong> Europe <strong>in</strong> the fight aga<strong>in</strong>st cartels. In fact, <strong>in</strong> the last several <strong>years</strong>,<br />
<strong>Italy</strong> has been by far the most aggressive jurisdiction, other than the U.S. <strong>and</strong> Canada, <strong>in</strong><br />
prosecut<strong>in</strong>g <strong>in</strong>ternational cartels. In <strong>20</strong>04, <strong>Italy</strong> accounted for 35% <strong>of</strong> the cartels discovered<br />
by the “other” national authorities, although its rate <strong>of</strong> discovery has dim<strong>in</strong>ished to about<br />
two cases per year s<strong>in</strong>ce 1999. In <strong>20</strong>08 alone, the <strong>Competition</strong> Authority imposed f<strong>in</strong>es for<br />
such violations totall<strong>in</strong>g approximately € 28 million.<br />
(a) Agreements Covered<br />
(i) Fix<strong>in</strong>g <strong>of</strong> Prices or Other Contractual Obligations<br />
<strong>The</strong> <strong>first</strong> example <strong>of</strong> prohibited agreements listed <strong>in</strong> Section 2 is the direct or <strong>in</strong>direct<br />
fix<strong>in</strong>g <strong>of</strong> purchase or resell<strong>in</strong>g prices or any other contractual conditions. 80 <strong>The</strong> <strong>Competition</strong><br />
Authority considers price fix<strong>in</strong>g to be a very serious <strong>in</strong>fr<strong>in</strong>gement s<strong>in</strong>ce pric<strong>in</strong>g is an<br />
essential form <strong>of</strong> competition. <strong>The</strong> <strong>Competition</strong> Authority’s <strong>practice</strong> is to strike down any<br />
price-fix<strong>in</strong>g agreement related to sell<strong>in</strong>g prices, 81 m<strong>in</strong>imum sell<strong>in</strong>g prices, 82<br />
