Clauses <strong>of</strong> an agreement that constitute <strong>and</strong> amount to an abuse <strong>of</strong> dom<strong>in</strong>ant position<br />

may also be found null. In Avir v. Eni, 601<br />

the Milan Court <strong>of</strong> Appeals found that price<br />

clauses conta<strong>in</strong>ed <strong>in</strong> gas supply agreements, through which the <strong>in</strong>cumbent gas operator had<br />

abused its dom<strong>in</strong>ant position by impos<strong>in</strong>g an excessive purchase price (so-called exploitative<br />

abuse), were null because they violated Section 3(a) <strong>of</strong> the <strong>Competition</strong> <strong>Law</strong>.<br />

Pursuant to Article 1422 <strong>of</strong> the Italian Civil Code, declaration <strong>of</strong> nullity is not subject to<br />

statutes <strong>of</strong> limitation.<br />

(c) Actions for Injunctive Relief<br />

Actions for <strong>in</strong>junctive relief can have different purposes. For <strong>in</strong>stance, the pla<strong>in</strong>tiff can<br />

request the Court to order a dom<strong>in</strong>ant company to grant access to certa<strong>in</strong> essential facilities<br />

or a cartel member to stop collud<strong>in</strong>g with competitors. Injunctions can be granted either as a<br />

f<strong>in</strong>al award or as an <strong>in</strong>terim measure.<br />

Pursuant to Articles 700 et seq. <strong>of</strong> the Italian Civil Procedure Code, an <strong>in</strong>terim measure<br />

may be requested if a pla<strong>in</strong>tiff reasonably fears that its rights are likely to be irreparably<br />

damaged dur<strong>in</strong>g the time that is necessary for reach<strong>in</strong>g an ord<strong>in</strong>ary proceed<strong>in</strong>g decision or<br />

judgment. In certa<strong>in</strong> cases a defendant has been ordered to enter <strong>in</strong>to a supply agreement 602<br />

or to cease <strong>and</strong> desist from cont<strong>in</strong>u<strong>in</strong>g its un<strong>law</strong>ful behavior 603<br />

until an ord<strong>in</strong>ary proceed<strong>in</strong>g<br />

decision or judgment can be reached.<br />

2. Cont<strong>in</strong>gency Fees<br />

Pursuant to new rules passed <strong>in</strong> <strong>20</strong>06, outcome-based fee arrangements are now<br />

permitted, arguably <strong>in</strong>clud<strong>in</strong>g “no w<strong>in</strong>, no fee” arrangements. 604<br />

<strong>The</strong>se types <strong>of</strong><br />

arrangements are to be stipulated <strong>in</strong> written form <strong>and</strong> consistent with the pr<strong>in</strong>ciple <strong>of</strong><br />

proportionality.<br />

3. Class Action<br />

<strong>The</strong> Italian Parliament has recently <strong>in</strong>troduced <strong>in</strong> the Italian legal system a class action<br />

system that, to a certa<strong>in</strong> extent, appears to be similar to those <strong>of</strong> certa<strong>in</strong> Common <strong>Law</strong><br />

countries. 605<br />

In particular, Article 140 bis <strong>of</strong> the Italian Consumer Code provides that, <strong>in</strong> case <strong>of</strong><br />

anticompetitive conducts affect<strong>in</strong>g a number <strong>of</strong> consumers or users, any <strong>of</strong> them has<br />
