Additionally, a refusal to deal by a dom<strong>in</strong>ant undertak<strong>in</strong>g cannot be an abuse under<br />

Section 3 if it is objectively justified. This is true when the dom<strong>in</strong>ant undertak<strong>in</strong>g does not<br />

have enough capacity to satisfy its own needs, the customer is <strong>in</strong>solvent, or the reputation <strong>of</strong><br />

the dom<strong>in</strong>ant undertak<strong>in</strong>g is at risk. 433<br />

(i) Refusal to Supply<br />

<strong>The</strong> <strong>Competition</strong> Authority has applied the pr<strong>in</strong>ciples mentioned above <strong>in</strong> a number <strong>of</strong><br />

cases. 434 For example, <strong>in</strong> Goriziane/Fiat Ferroviaria, 435 the <strong>Competition</strong> Authority found<br />

that Fiat Ferroviana (FF), the dom<strong>in</strong>ant firm <strong>in</strong> the markets for FIAT/IVECO diesel<br />

locomotives, locomotive eng<strong>in</strong>es, <strong>and</strong> spare parts <strong>in</strong>fr<strong>in</strong>ged the <strong>Competition</strong> <strong>Law</strong> by refus<strong>in</strong>g<br />

to supply orig<strong>in</strong>al spare parts to its customers who were, at the same time, competitors on<br />

the related market for locomotive eng<strong>in</strong>e ma<strong>in</strong>tenance <strong>and</strong> servic<strong>in</strong>g. <strong>The</strong> supply <strong>of</strong> these<br />

spare parts was one <strong>of</strong> the essential requirements for participat<strong>in</strong>g <strong>in</strong> a public tender. <strong>The</strong><br />

<strong>Competition</strong> Authority found that FF’s behavior was not objectively justified <strong>and</strong> had the<br />

effect <strong>of</strong> imped<strong>in</strong>g the development <strong>of</strong> competition <strong>in</strong> a new market by reserv<strong>in</strong>g the market<br />

to FF itself. 436 Refusal to supply a new client can also be an abuse <strong>of</strong> a dom<strong>in</strong>ant position. 437<br />

<strong>The</strong> imposition <strong>of</strong> certa<strong>in</strong> conditions by a dom<strong>in</strong>ant undertak<strong>in</strong>g before grant<strong>in</strong>g access<br />

to a service might have the same effect as an outright refusal to deal, <strong>and</strong>, therefore, can be<br />

considered un<strong>law</strong>ful. In Infocamere/Cerved,<br />

However, it is worth not<strong>in</strong>g that, <strong>in</strong> a rul<strong>in</strong>g annull<strong>in</strong>g a decision <strong>in</strong> which the<br />

<strong>Competition</strong> Authority held that Otis/Ceam, Kone, <strong>and</strong> Sch<strong>in</strong>dler had abused their dom<strong>in</strong>ant<br />

positions <strong>in</strong> the markets for orig<strong>in</strong>al spare parts for their respective elevators, the TAR held<br />

the <strong>Competition</strong> Authority found a dom<strong>in</strong>ant<br />

undertak<strong>in</strong>g, Infocamere, <strong>in</strong> violation <strong>of</strong> the <strong>Competition</strong> <strong>Law</strong> because it conditioned the<br />

access to its database, <strong>in</strong>ter alia, upon the customers hav<strong>in</strong>g capital stock <strong>of</strong> ITL 5 billion<br />

(approximately € 2.5 million). <strong>The</strong> <strong>Competition</strong> Authority decided that the requirement<br />

prevented many operators from ga<strong>in</strong><strong>in</strong>g access to <strong>in</strong>formation that was necessary for them to<br />

compete <strong>in</strong> the market.<br />
