that the <strong>Competition</strong> Authority had applied the <strong>in</strong>correct evidentiary st<strong>and</strong>ard by fail<strong>in</strong>g to<br />

establish a “solid <strong>and</strong> conv<strong>in</strong>c<strong>in</strong>g” body <strong>of</strong> evidence. 439<br />

Accord<strong>in</strong>g to the TAR, evidence <strong>of</strong> a<br />

s<strong>in</strong>gle refusal to supply by a subsidiary <strong>of</strong> one <strong>of</strong> the three groups <strong>in</strong>volved <strong>in</strong> the<br />

<strong>in</strong>vestigation was <strong>in</strong>sufficient, because a refusal to supply by a dom<strong>in</strong>ant firm is abusive<br />

only if such conduct is repeated <strong>and</strong> generalized <strong>and</strong> is thus capable <strong>of</strong> clearly prov<strong>in</strong>g the<br />

anticompetitive <strong>in</strong>tent <strong>of</strong> the undertak<strong>in</strong>g concerned.<br />

(ii) Refusal to Grant Access to Essential Facility<br />

Consistent with the pr<strong>in</strong>ciples <strong>of</strong> EU competition <strong>law</strong>, the <strong>Competition</strong> Authority<br />

def<strong>in</strong>es an essential facility as “a facility or an <strong>in</strong>frastructure which is essential for reach<strong>in</strong>g<br />

customers <strong>and</strong>/or enabl<strong>in</strong>g competitors to carry on their bus<strong>in</strong>ess, <strong>and</strong> which cannot be<br />

replicated by any reasonable means.” 440 An undertak<strong>in</strong>g that owns or controls such<br />

<strong>in</strong>frastructure <strong>and</strong> refuses to grant access to it, or grants access to it at discrim<strong>in</strong>atory terms,<br />

without an objective justification, <strong>in</strong>fr<strong>in</strong>ges Section 3 <strong>of</strong> the <strong>Competition</strong> <strong>Law</strong>. 441 To be<br />

characterized as an essential facility, access to the facility must be essential to operate <strong>in</strong> the<br />

relevant market Additionally, there cannot be viable alternatives available or the possibility<br />

<strong>of</strong> duplication due to technical, legislative, <strong>and</strong> economic constra<strong>in</strong>ts. 442<br />

Refusal to grant access to an essential facility is not un<strong>law</strong>ful if the <strong>Competition</strong><br />

Authority f<strong>in</strong>ds that there is an objective justification for the refusal. A refusal to grant<br />

access might be justified, for example, when the owner <strong>of</strong> the facility does not have enough<br />

capacity (capacity saturation), when the counterpart is <strong>in</strong>solvent or does not respect the<br />

contractual conditions, or when the undertak<strong>in</strong>g request<strong>in</strong>g access does not have the<br />

technical or security requirements needed for it to have a secure access to the <strong>in</strong>frastructure.<br />

Conversely, lack <strong>of</strong> an unsatisfied dem<strong>and</strong> <strong>in</strong> the downstream market is not an objective<br />

justification for such refusal.<br />

Accord<strong>in</strong>g to the <strong>Competition</strong> Authority, regasification term<strong>in</strong>als belong to a separate market from<br />

pipel<strong>in</strong>es; for this reason, GNL Italia was a de facto monopolist on this market.<br />
