(2) Is currently registered as a professional engineer by appropriate authority of a<br />

state of the United States or a province of Canada; or<br />

(3) Has at least three years' experience in performing the duties of a Design<br />

Certifying Engineer prior to September 1, 1991.<br />

Designated facility means a hazardous waste treatment, storage, or disposal<br />

facility that has been designated on the manifest by the generator.<br />

Diagnostic specimen. See § 173.134 of this subchapter.<br />

District Comm<strong>and</strong>er means the District Comm<strong>and</strong>er of the Coast Guard, or his<br />

authorized representative, who has jurisdiction in the particular geographical<br />

area.<br />

Division means a subdivision of a hazard class.<br />

DOD means the U.S. Department of Defense.<br />

Domestic transportation means transportation between places within the<br />

United States other than through a foreign country.<br />

DOT or Department means U.S. Department of Transportation.<br />

Drum means a flat-ended or convex-ended cylindrical packaging made of metal,<br />

fiberboard, plastic, plywood, or other suitable materials. This definition also<br />

includes packagings of other shapes made of metal or plastic (e.g., round tapernecked<br />

packagings or pail-shaped packagings) but does not include cylinders,<br />

jerricans, wooden barrels or bulk packagings.<br />

Elevated temperature material means a material which, when offered for<br />

transportation or transported in a bulk packaging:<br />

(1) Is in a liquid phase <strong>and</strong> at a temperature at or above 100 °C (212 °F);<br />

(2) Is in a liquid phase with a flash point at or above 37.8 °C (100 °F) that is<br />

intentionally heated <strong>and</strong> offered for transportation or transported at or above its<br />

flash point; or<br />

(3) Is in a solid phase <strong>and</strong> at a temperature at or above 240 °C (464 °F).<br />

Engine means a locomotive propelled by any form of energy <strong>and</strong> used by a<br />

railroad.<br />
