According to article 5 <strong>of</strong> the Stockholm Convention<br />

Each Party shall [take]... the following measures to reduce the total releases ...<br />

from anthropogenic sources <strong>of</strong> each <strong>of</strong> the chemicals listed in Annex C, ...:<br />

(a) Develop an action plan ... within two years <strong>of</strong> the date <strong>of</strong> entry into force <strong>of</strong><br />

this Convention ... designed to identify, characterize <strong>and</strong> address the<br />

release <strong>of</strong> the chemicals listed in Annex C ... .<br />

(b) The action plan shall include the following elements:<br />

(i) An evaluation <strong>of</strong> current <strong>and</strong> projected releases, including the<br />

development <strong>and</strong> maintenance <strong>of</strong> source inventories <strong>and</strong> release<br />

estimates, taking into consideration the source categories identified in<br />

Annex C;<br />

(ii) An evaluation <strong>of</strong> the efficacy <strong>of</strong> the laws <strong>and</strong> policies <strong>of</strong> the Party relating<br />

to the management <strong>of</strong> such releases;<br />

(iii) Strategies to meet the obligations <strong>of</strong> this paragraph, taking into account<br />

the evaluations in (i) <strong>and</strong> (ii);<br />

Aarhus Protocol<br />

The Aarhus Protocol to the UNECE Convention on Long-range transboundary Air Pollution is<br />

focussed on control, reduction <strong>of</strong> discharges, emissions <strong>and</strong> losses <strong>of</strong> persistent organic<br />

pollutants by elimination or restriction <strong>of</strong> substances from use. Besides the 12 Stockholm<br />

POPs the Protocol covers Chlordecone, HCH, HxBB <strong>and</strong> PAH which are not subject to the<br />

Stockholm Convention.<br />

The Aarhus Protocol under the UNECE Convention obliges Member States in its article 3 (5<br />

(a)) to reduce its total annual emissions <strong>of</strong> each <strong>of</strong> the substances listed in annex III in<br />

accordance with that annex by taking effective measures, appropriate in its particular<br />

circumstances.<br />

Regulation 850/2004/EC<br />

In order to ensure coherent <strong>and</strong> effective implementation <strong>of</strong> the Community’s obligations<br />

under the Protocol <strong>and</strong> the Convention, a common legal framework has been established at<br />

EU level by the Regulation (EC) 850/2004 <strong>of</strong> the European Parliament <strong>and</strong> <strong>of</strong> the Council.<br />

In the Regulation the provisions <strong>of</strong> the above mentioned Conventions <strong>and</strong> the Protocol have<br />

been implemented for the scope <strong>of</strong> the European Community.<br />
