3 Introduction<br />

Piracy has long been a major cause for concern<br />

for <strong>the</strong> global film <strong>in</strong>dustry. S<strong>in</strong>ce <strong>the</strong><br />

appearance <strong>of</strong> <strong>the</strong> videocassette <strong>in</strong> <strong>the</strong> 1970s,<br />

<strong>the</strong> illegal manufacture and sale <strong>of</strong> pirated<br />

movie content has <strong>in</strong>creased enormously.<br />

However, while until recently movie piracy has<br />

been a ‘physical’ activity us<strong>in</strong>g analogue<br />

technology, <strong>the</strong> digital revolution has triggered<br />

a quantum leap <strong>in</strong> <strong>the</strong> means <strong>of</strong> copy<strong>in</strong>g and<br />

dissem<strong>in</strong>at<strong>in</strong>g copyrighted works. With <strong>the</strong><br />

advent <strong>of</strong> <strong>the</strong> Internet and <strong>the</strong> accelerated<br />

development <strong>of</strong> ‘<strong>of</strong>f-<strong>the</strong>-shelf’ digital<br />

enterta<strong>in</strong>ment and PC technologies, it is now<br />

easier than ever to illegally copy and distribute<br />

film content. This applies both to copy<strong>in</strong>g by<br />

large-scale crim<strong>in</strong>al organisations and to illegal<br />

copy<strong>in</strong>g by consumers.<br />

In short, <strong>the</strong> digital age, has brought with it a<br />

startl<strong>in</strong>g array <strong>of</strong> threats and challenges. If<br />

<strong>the</strong>se threats and challenges are not addressed<br />

<strong>the</strong>y could have extremely serious<br />

consequences for <strong>the</strong> film bus<strong>in</strong>ess, and for <strong>the</strong><br />

diversity <strong>of</strong> film culture, across <strong>the</strong> globe. To<br />

this end, this report evaluates <strong>the</strong> task ahead<br />

for <strong>the</strong> <strong>UK</strong> film <strong>in</strong>dustry, as it squares up to <strong>the</strong><br />

challenge posed by film <strong><strong>the</strong>ft</strong> <strong>in</strong> <strong>the</strong> early 21st<br />

century.<br />

There are five key sections to this report:<br />

• An exam<strong>in</strong>ation <strong>of</strong> <strong>the</strong> current climate <strong>of</strong> film<br />

<strong><strong>the</strong>ft</strong> as it impacts <strong>the</strong> <strong>UK</strong> film <strong>in</strong>dustry, with a<br />

special focus on <strong>the</strong> emerg<strong>in</strong>g threats from<br />

onl<strong>in</strong>e piracy and Internet fileshar<strong>in</strong>g.<br />

• An assessment <strong>of</strong> <strong>the</strong> measures available to<br />

combat piracy <strong>in</strong> <strong>the</strong> <strong>UK</strong>; particular attention is<br />

given to legal and enforcement methods. This<br />

section also <strong>in</strong>cludes exam<strong>in</strong>ation <strong>of</strong> possible<br />

security measures, education and consumer<br />

awareness <strong>in</strong>itiatives, and <strong>the</strong> development <strong>of</strong><br />

new bus<strong>in</strong>ess models for <strong>the</strong> <strong>in</strong>dustry.<br />

• A review <strong>of</strong> consumer attitudes and<br />

behaviour, and how <strong>the</strong> film <strong>in</strong>dustry might<br />

respond to <strong>the</strong> challenges <strong>of</strong> balanc<strong>in</strong>g <strong>the</strong><br />

rights <strong>of</strong> citizens and consumers with those <strong>of</strong><br />

content providers.<br />

• Prelim<strong>in</strong>ary recommendations on how <strong>the</strong><br />

<strong>UK</strong> government, film <strong>in</strong>dustry and o<strong>the</strong>r<br />

stakeholders <strong>in</strong> <strong>the</strong> film sector, such as <strong>the</strong> <strong>UK</strong><br />

<strong>Film</strong> Council and <strong>the</strong> Federation Aga<strong>in</strong>st<br />

<strong>Copyright</strong> Theft (FACT), can work toge<strong>the</strong>r to<br />

deal with <strong>the</strong> growth <strong>of</strong> film piracy.<br />

• An appendix which <strong>in</strong>cludes an analysis <strong>of</strong><br />

<strong>the</strong> music <strong>in</strong>dustry’s experience – an <strong>in</strong>dustry<br />

that has suffered significant losses from both<br />

physical piracy and file-shar<strong>in</strong>g over <strong>the</strong><br />

Internet because <strong>of</strong> a failure to act <strong>in</strong> a timely<br />

fashion.<br />
