P2P networks have gone through at least three<br />
ma<strong>in</strong> generations <strong>of</strong> technology <strong>in</strong> <strong>the</strong>ir short<br />
history, each new one mak<strong>in</strong>g <strong>the</strong> shar<strong>in</strong>g <strong>of</strong><br />
large movie files easier and at <strong>the</strong> same time<br />
becom<strong>in</strong>g harder to police. Napster was <strong>the</strong><br />
orig<strong>in</strong>al first-generation P2P network and<br />
application that popularised <strong>the</strong> concept to<br />
millions <strong>of</strong> users around <strong>the</strong> world. This was<br />
followed by <strong>the</strong> second-generation network<br />
Gnutella that advanced <strong>the</strong> technology by<br />
remov<strong>in</strong>g <strong>the</strong> requirement for <strong>the</strong> centralised<br />
servers used by Napster. Although <strong>the</strong> latter<br />
was efficient and user-friendly, it made polic<strong>in</strong>g<br />
easy – just a question <strong>of</strong> shutt<strong>in</strong>g down <strong>the</strong><br />
central servers that <strong>in</strong>dexed <strong>the</strong> files held on<br />
users’ own mach<strong>in</strong>es. By contrast, <strong>the</strong> Gnutella<br />
network was completely decentralised and<br />
connected users directly to each o<strong>the</strong>r without<br />
<strong>the</strong> need for a centralised server.<br />
Third-generation P2P technology has taken <strong>the</strong><br />
Gnutella concept a stage fur<strong>the</strong>r by improv<strong>in</strong>g<br />
<strong>the</strong> efficiency <strong>of</strong> <strong>the</strong> network<strong>in</strong>g process and<br />
enhanc<strong>in</strong>g file transfer speeds as well as cutt<strong>in</strong>g<br />
<strong>the</strong> time required to search for desirable files.<br />
The most important third-generation P2P<br />
network is called Fasttrack. A number <strong>of</strong> client<br />
applications have been developed to use this<br />
network, <strong>in</strong>clud<strong>in</strong>g Kazaa, Grokster and<br />
Morpheus.<br />
Sharman Networks, <strong>the</strong> company beh<strong>in</strong>d <strong>the</strong><br />
Kazaa application, has recorded over 250<br />
million downloads <strong>of</strong> its s<strong>of</strong>tware worldwide,<br />
cit<strong>in</strong>g 60 million regular users around <strong>the</strong><br />
globe. Though <strong>the</strong>re has been a recent dip <strong>in</strong><br />
Kazaa’s numbers, this has been attributed to<br />
<strong>the</strong> appearance <strong>of</strong> a new generation <strong>of</strong><br />
applications. This latest generation <strong>of</strong><br />
applications are specifically designed to<br />
facilitate <strong>the</strong> download<strong>in</strong>g and shar<strong>in</strong>g <strong>of</strong> large<br />
files, such as films. Examples <strong>of</strong> <strong>the</strong>se new<br />
protocols are BitTorrent, Overnet and<br />
eDonkey 21 . The latter saw its user-base triple to<br />
1.8 million <strong>in</strong> 2003.<br />
It should, however, be noted that <strong>the</strong> new P2P<br />
services are claimed not to be solely designed<br />
for illegal distribution <strong>of</strong> content – one <strong>of</strong> <strong>the</strong><br />
factors that have made legal attempts to shut<br />
<strong>the</strong>m down largely unsuccessful – so far 22 .<br />
Sharman Networks is an example <strong>of</strong> a P2P<br />
company encourag<strong>in</strong>g legitimate use <strong>of</strong> its<br />
product. In 2003, its US-based digital content<br />
partner Altnet struck a deal with IndiaFM.com,<br />
a popular Bollywood website, to make available<br />
paid-for downloads to Kazaa users <strong>of</strong> movies<br />
from 35 Bollywood producers. The first title,<br />
Supari, was made available <strong>in</strong> November 2003<br />
for $2.99. The downloaded file is encoded by<br />
proprietary copy-protection solutions, and selfdestructs<br />
after view<strong>in</strong>g.<br />
But <strong>the</strong> fact is, <strong>in</strong> <strong>the</strong> P2P environment, gett<strong>in</strong>g<br />
illegal movies for free on <strong>the</strong> Internet has never<br />
been easier. With<strong>in</strong> a s<strong>in</strong>gle day <strong>of</strong> release, The<br />
Matrix Reloaded, which had a tight security<br />
cordon drawn around all preview screen<strong>in</strong>gs<br />
(<strong>in</strong>clud<strong>in</strong>g <strong>the</strong> bann<strong>in</strong>g <strong>of</strong> all electronic<br />
devices), was available on Kazaa, and attracted<br />
approximately 200,000 downloads with<strong>in</strong> <strong>the</strong><br />
first week. Similarly Disney’s F<strong>in</strong>d<strong>in</strong>g Nemo and<br />
Fox’s Daredevil found <strong>the</strong>mselves on P2P<br />
networks with<strong>in</strong> one day and three days<br />
respectively <strong>of</strong> <strong>the</strong>ir <strong>the</strong>atrical release. One <strong>of</strong><br />
<strong>the</strong> earliest victims was Star Wars Episode II:<br />
The Attack <strong>of</strong> <strong>the</strong> Clones, available <strong>in</strong> 2002 on<br />
P2P networks a week before its premiere.<br />
The emphasis from downloaders throughout<br />
appears to be access to new and blockbuster<br />
content. In December 2003, accord<strong>in</strong>g to<br />
BayTSP, a digital track<strong>in</strong>g firm serv<strong>in</strong>g some <strong>of</strong><br />
<strong>the</strong> US studios, Term<strong>in</strong>ator 3: The Rise <strong>of</strong> <strong>the</strong><br />
Mach<strong>in</strong>es was <strong>the</strong> most widely available film on<br />
P2P networks, with 57,008 locations available<br />
for download (this, says <strong>the</strong> company, was a<br />
slight decl<strong>in</strong>e from 62,827 locations <strong>in</strong><br />
November).<br />
P2P fileshar<strong>in</strong>g also seems to be act<strong>in</strong>g as a<br />
‘preview’ process by some downloaders. In<br />
2003, for example, Universal Pictures’ The Hulk<br />
was leaked onto a P2P fileshar<strong>in</strong>g network<br />
