a notice is served for <strong>in</strong>fr<strong>in</strong>g<strong>in</strong>g items to be<br />
removed. If <strong>the</strong> traders cont<strong>in</strong>ue to post <strong>the</strong><br />
<strong>in</strong>fr<strong>in</strong>g<strong>in</strong>g items, <strong>the</strong>y may be liable to a full<br />
FACT <strong>in</strong>vestigation that could end <strong>in</strong><br />
prosecution. One example was that <strong>of</strong> an<br />
<strong>in</strong>dividual <strong>in</strong> Derbyshire who headed up a<br />
counterfeit r<strong>in</strong>g aid<strong>in</strong>g onl<strong>in</strong>e sales <strong>of</strong> <strong>in</strong>fr<strong>in</strong>g<strong>in</strong>g<br />
product. After a long and protracted<br />
<strong>in</strong>vestigation and collation <strong>of</strong> evidence, <strong>the</strong><br />
trader responsible for <strong>the</strong> onl<strong>in</strong>e payment<br />
system to facilitate all f<strong>in</strong>ancial transactions<br />
was prosecuted <strong>in</strong> March 2002 and pleaded<br />
guilty to <strong>of</strong>fences under <strong>the</strong> Trade Marks Act.<br />
Accord<strong>in</strong>g to FACT, he was sentenced to six<br />
months imprisonment and ordered to pay costs<br />
<strong>of</strong> £8,000 46 . All <strong>of</strong>fend<strong>in</strong>g doma<strong>in</strong>s were closed<br />
down.<br />
Most recently <strong>in</strong> January 2004, FACT, work<strong>in</strong>g<br />
<strong>in</strong> conjunction with <strong>the</strong> British Phonographic<br />
Industry (BPI) and Police and Trad<strong>in</strong>g Standards,<br />
smashed an Internet piracy r<strong>in</strong>g, which<br />
consisted <strong>of</strong> 300 subscribers, <strong>in</strong> approximately<br />
a dozen major <strong>UK</strong> towns and cities. Accord<strong>in</strong>g<br />
to FACT, material found ranged from music,<br />
films, s<strong>of</strong>tware, computer games and<br />
paedophilic material.<br />
However, such actions do not address <strong>the</strong><br />
biggest threat posed by <strong>the</strong> Internet: P2P<br />
fileshar<strong>in</strong>g networks. Although FACT’s<br />
monitor<strong>in</strong>g <strong>of</strong> onl<strong>in</strong>e activity can also take it<br />
<strong>in</strong>to P2P fileshar<strong>in</strong>g, <strong>the</strong> effective monitor<strong>in</strong>g <strong>of</strong><br />
P2P networks and o<strong>the</strong>r Internet distribution<br />
channels is a highly specialist activity requir<strong>in</strong>g<br />
advanced technical capabilities and systems.<br />
This is currently mostly <strong>the</strong> preserve <strong>of</strong> a<br />
handful <strong>of</strong> expert companies, which mostly<br />
reside <strong>in</strong> <strong>the</strong> US.<br />
In general terms, it is fair to suggest that <strong>the</strong><br />
film <strong>in</strong>dustry has yet to formulate a fully<br />
coherent strategy to deal with copyright<br />
<strong>in</strong>fr<strong>in</strong>gements via P2P networks. One reason for<br />
this is that, <strong>in</strong> <strong>the</strong> ma<strong>in</strong>, P2P users are not<br />
trad<strong>in</strong>g film files as a commercial act, but<br />
exchange files with o<strong>the</strong>r users as a means <strong>of</strong><br />
sav<strong>in</strong>g money. This dim<strong>in</strong>ishes legitimate sales<br />
s<strong>in</strong>ce P2P users acquire and dissem<strong>in</strong>ate<br />
copyright material without pay<strong>in</strong>g <strong>the</strong><br />
copyright holder for <strong>the</strong> privilege.<br />
One approach <strong>of</strong> <strong>the</strong> music <strong>in</strong>dustry has been<br />
to sue <strong>in</strong>dividual P2P users, primarily teenagers<br />
and students, for copyright <strong>in</strong>fr<strong>in</strong>gement.<br />
Whe<strong>the</strong>r or not this is a desirable tactic for <strong>the</strong><br />
film <strong>in</strong>dustry to pursue is addressed <strong>in</strong> <strong>the</strong> next<br />
chapter. The film <strong>in</strong>dustry so far has not sued<br />
<strong>in</strong>dividual P2P users. The MPA and its member<br />
companies are, however, consider<strong>in</strong>g all <strong>of</strong><br />
<strong>the</strong>ir legal enforcement options aga<strong>in</strong>st P2P<br />
services and aga<strong>in</strong>st <strong>the</strong> heavy users <strong>of</strong> such<br />
services, although <strong>the</strong> MPA member companies<br />
view litigation as an option <strong>of</strong> last resort.<br />
The MPA’s worldwide Internet Enforcement<br />
programme is currently focused on notify<strong>in</strong>g<br />
ISPs <strong>of</strong> <strong>the</strong> abuse <strong>of</strong> <strong>the</strong>ir services. The<br />
programme uses a search eng<strong>in</strong>e to search <strong>the</strong><br />
Internet, look<strong>in</strong>g for unauthorised files. When<br />
it f<strong>in</strong>ds an <strong>in</strong>fr<strong>in</strong>gement, an email is sent to <strong>the</strong><br />
service provider, seek<strong>in</strong>g <strong>the</strong> tak<strong>in</strong>g down or<br />
block<strong>in</strong>g <strong>of</strong> <strong>the</strong> site or file <strong>in</strong> question. Over<br />
225,000 such notices were issued <strong>in</strong> 2003, over<br />
101,000 <strong>of</strong> <strong>the</strong>m to ISPs located <strong>in</strong> <strong>the</strong><br />
European, Middle East and African region. The<br />
vast majority <strong>of</strong> <strong>the</strong> notices sent concern illegal<br />
download<strong>in</strong>g, particularly P2P <strong>in</strong>fr<strong>in</strong>gements.<br />
This process <strong>of</strong> search<strong>in</strong>g takes place <strong>in</strong> <strong>the</strong><br />
public space <strong>of</strong> <strong>the</strong> Internet and <strong>the</strong> ma<strong>in</strong> focus<br />
is on <strong>the</strong> service provider, not <strong>the</strong> user.<br />
However, accord<strong>in</strong>g to <strong>the</strong> MPA, ISPs have been<br />
becom<strong>in</strong>g <strong>in</strong>creas<strong>in</strong>gly unco-operative <strong>in</strong><br />
relation to downloads, but rema<strong>in</strong> reasonably<br />
helpful <strong>in</strong> <strong>the</strong> fight aga<strong>in</strong>st hard goods piracy.<br />
The MPA also pursues repeat <strong>in</strong>fr<strong>in</strong>gers from<br />
time to time, and encourages local <strong>in</strong>itiatives<br />
designed to secure crim<strong>in</strong>al enforcement<br />
aga<strong>in</strong>st Internet piracy that is commercial,<br />
organised, or large scale. S<strong>in</strong>ce 2001, FACT has<br />
been a member <strong>of</strong> <strong>the</strong> Internet Enforcement<br />
Group (IEG), a cross-<strong>in</strong>dustry body <strong>of</strong> Internet<br />
<strong>in</strong>vestigators represent<strong>in</strong>g <strong>the</strong> book publish<strong>in</strong>g,<br />
music, games, s<strong>of</strong>tware, merchandis<strong>in</strong>g and<br />
film <strong>in</strong>dustries. The IEG meets to share
