5 Combat<strong>in</strong>g film <strong><strong>the</strong>ft</strong><br />

There are several methods available to<br />

government and <strong>in</strong>dustry to combat piracy:<br />

• Streng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> legal framework;<br />

• Improv<strong>in</strong>g enforcement efforts;<br />

• Enhanc<strong>in</strong>g <strong>in</strong>dustry security measures;<br />

• Improv<strong>in</strong>g education and consumer<br />

awareness; and<br />

• Develop<strong>in</strong>g new services and bus<strong>in</strong>ess<br />

models.<br />

All <strong>of</strong> <strong>the</strong>se methods are already part <strong>of</strong> <strong>the</strong><br />

<strong>in</strong>dustry’s strategy to combat piracy. However,<br />

<strong>the</strong>re is still much that needs to be done.<br />

The root causes <strong>of</strong> piracy can be broken down<br />

<strong>in</strong>to three simple rules <strong>of</strong> access, quality and<br />

cost. That is:<br />

• If <strong>the</strong>re is a gap <strong>in</strong> supply, <strong>the</strong> pirates will<br />

exploit <strong>the</strong> opportunity.<br />

• If <strong>the</strong> retail price <strong>of</strong> content is perceived to be<br />

too high, or higher than that which <strong>the</strong><br />

consumer feels justified given <strong>the</strong> quality <strong>of</strong><br />

that content, <strong>the</strong>n <strong>the</strong> pirates will achieve sales<br />

at a lower price 36 .<br />

• If <strong>the</strong> conditions under which a product can<br />

be acquired are perceived to be too strict, <strong>the</strong><br />

pirates will provide an easier alternative.<br />

The above operates <strong>in</strong> an environment <strong>in</strong> which<br />

<strong>the</strong> <strong><strong>the</strong>ft</strong> <strong>of</strong> <strong>in</strong>tellectual property is not<br />

considered by authorities and <strong>the</strong> judicial<br />

system as a serious enough crim<strong>in</strong>al activity to<br />

warrant robust regulation, and where rich<br />

pick<strong>in</strong>gs are to be had from what rema<strong>in</strong>s a<br />

low risk, high reward illegal racket operat<strong>in</strong>g <strong>in</strong><br />

<strong>the</strong> context <strong>of</strong> widespread ignorance <strong>of</strong><br />

<strong>in</strong>tellectual property rights.<br />

It is also important to recognise that not all<br />

unauthorised copyright use is organised, nor is<br />

it undertaken for f<strong>in</strong>ancial ga<strong>in</strong>.<br />

The demographics <strong>of</strong> piracy<br />

Large-scale physical piracy tends to be <strong>the</strong><br />

doma<strong>in</strong> <strong>of</strong> organised crime. That is,<br />

pr<strong>of</strong>essional operations usually seek<strong>in</strong>g refuge<br />

<strong>in</strong> countries with a relaxed anti-piracy regime;<br />

such as Pakistan, Russia, and some territories <strong>in</strong><br />

<strong>the</strong> Far East. In contrast, unauthorised Internet<br />

download<strong>in</strong>g, <strong>in</strong> terms <strong>of</strong> P2P fileshar<strong>in</strong>g, is<br />

typically <strong>the</strong> playground <strong>of</strong> juveniles and young<br />

film buffs; teenagers and students who have a<br />

high volume appetite for movies, but do not<br />

necessarily have ei<strong>the</strong>r <strong>the</strong> will or f<strong>in</strong>ancial<br />

ability to satisfy that appetite. The key<br />

underly<strong>in</strong>g difference is that <strong>the</strong>re is no direct<br />

economic ga<strong>in</strong> for <strong>the</strong> Internet filesharers, as<br />

<strong>the</strong>re is for <strong>the</strong> pr<strong>of</strong>essional pirates.<br />

Pr<strong>of</strong>essional commercial piracy is based on a<br />

simple supply-and-demand rule, which takes<br />

advantage <strong>of</strong> gaps evident <strong>in</strong> <strong>the</strong> ‘w<strong>in</strong>dows’<br />

model <strong>of</strong> film distribution. Counterfeit discs are<br />

made for next to noth<strong>in</strong>g, and <strong>the</strong>n sold on for<br />

a pr<strong>of</strong>it to consumers who wish to see <strong>the</strong> films<br />

quickly and cheaply.<br />
