average 4.2 CDs a month. The IFPI estimated<br />
that <strong>the</strong>re was an estimated 900 million<br />
<strong>in</strong>fr<strong>in</strong>g<strong>in</strong>g music files on <strong>the</strong> Internet as <strong>of</strong><br />
January 2004, from an estimated 6.2 million<br />
simultaneous P2P users.<br />
In <strong>the</strong> <strong>UK</strong>, where commercial piracy statistics<br />
also take <strong>in</strong>to account illegal ‘home burn<strong>in</strong>g’ <strong>of</strong><br />
CDs <strong>in</strong> conjunction with an Internet<br />
download<strong>in</strong>g service, <strong>the</strong> picture is quite<br />
alarm<strong>in</strong>g. In 2000, <strong>the</strong> <strong>UK</strong> CD sales market<br />
amounted to 314 million units, <strong>of</strong> which 31%<br />
were thought to be illegitimate copies. By<br />
2002, where <strong>the</strong> total market was 406 million<br />
units, legitimate sales held practically<br />
unchanged whilst <strong>the</strong> unauthorised market<br />
share was said to be 45% and ris<strong>in</strong>g fast. 65 The<br />
BPI estimates that <strong>in</strong> 2004, <strong>the</strong> number <strong>of</strong> CDs<br />
illegitimately burnt <strong>in</strong> <strong>the</strong> home will overtake<br />
those legitimately bought <strong>in</strong> shops. It is<br />
calculated that consumers are annually burn<strong>in</strong>g<br />
<strong>in</strong> excess <strong>of</strong> 120 million CDs from music<br />
downloaded from <strong>the</strong> Internet.<br />

The ease <strong>of</strong> download<strong>in</strong>g and record<strong>in</strong>g <strong>in</strong> <strong>the</strong><br />
home is also enabl<strong>in</strong>g <strong>the</strong> bus<strong>in</strong>ess models <strong>of</strong><br />
pr<strong>of</strong>essional commercial pirates to evolve. The<br />
BPI’s Anti-Piracy Unit is <strong>in</strong>creas<strong>in</strong>gly<br />
encounter<strong>in</strong>g commercial pirates who are<br />
operat<strong>in</strong>g ‘CD factories’ from a garage or spare<br />
room at home and <strong>the</strong>n sell<strong>in</strong>g <strong>the</strong> product via<br />
car boot sales or places <strong>of</strong> work.<br />
The impact for <strong>in</strong>dividual companies <strong>of</strong> <strong>the</strong><br />
downturn <strong>in</strong> <strong>the</strong> music market has been<br />
devastat<strong>in</strong>g. Sony Music Enterta<strong>in</strong>ment, for<br />
example, has been forced to streaml<strong>in</strong>e its<br />
operations and cut advertis<strong>in</strong>g costs. Despite<br />
this, <strong>the</strong> company still reported quarterly losses<br />
<strong>of</strong> $50 million <strong>in</strong> mid-2003, show<strong>in</strong>g quarterly<br />
sales to have capitulated below $1 billion.<br />
Why digital music piracy<br />
exploded<br />
The major record labels were hit hard by digital<br />
piracy because <strong>the</strong>y failed to respond from <strong>the</strong><br />
outset to threats and opportunities raised by<br />
<strong>the</strong> development <strong>of</strong> broadband Internet.<br />
Though Strauss Zelnick, <strong>the</strong> former CEO <strong>of</strong><br />
BMG, praised <strong>the</strong> development <strong>of</strong> onl<strong>in</strong>e music<br />
distribution as far back as July 2000, expect<strong>in</strong>g<br />
it to ‘more than double’ <strong>the</strong> music bus<strong>in</strong>ess,<br />
<strong>the</strong> practical stance adopted by <strong>the</strong> music<br />
<strong>in</strong>dustry was to ‘sit back’. That is, <strong>the</strong> majors<br />
took <strong>the</strong> view that <strong>the</strong>y could wait and see<br />
ra<strong>the</strong>r than pioneer, believ<strong>in</strong>g that content,<br />
deep pockets and market<strong>in</strong>g muscle would<br />
