B<strong>in</strong>d<strong>in</strong>g regulations <strong>of</strong> land use and <strong>of</strong> development are effected through detailed<br />
development plans. Alternatively, area regulations may be adopted, if needed to<br />
achieve <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> comprehensive plan or to ensure <strong>the</strong> safeguard<strong>in</strong>g <strong>of</strong><br />
national <strong>in</strong>terests. With <strong>the</strong>se two plann<strong>in</strong>g <strong>in</strong>struments a local government may<br />
decide upon regulations <strong>in</strong> several respects which affect <strong>the</strong> preservation <strong>of</strong> cultural<br />
values. It may e.g. regulate <strong>the</strong> extent to which plann<strong>in</strong>g permission and demolition<br />
permission is needed for <strong>in</strong>dividual projects. It may fur<strong>the</strong>r prohibit demolition and<br />
lay down particulars for how build<strong>in</strong>gs <strong>of</strong> particular cultural value should be<br />
preserved.<br />
Regardless <strong>of</strong> whe<strong>the</strong>r a demolition prohibition has been decided upon <strong>in</strong> advance <strong>in</strong><br />
a plan or area regulation, <strong>the</strong> local government may refuse applications to demolish<br />
build<strong>in</strong>gs which are culturally particularly valuable.<br />
Decisions under <strong>the</strong> Plann<strong>in</strong>g and Build<strong>in</strong>g act can be appealed aga<strong>in</strong>st to <strong>the</strong> County<br />
Adm<strong>in</strong>istration, and fur<strong>the</strong>r ei<strong>the</strong>r to <strong>the</strong> government or to an adm<strong>in</strong>strative court <strong>of</strong><br />
law.<br />
To <strong>the</strong> extent b<strong>in</strong>d<strong>in</strong>g plann<strong>in</strong>g measures or refusals to grant demolition permission<br />
cause economic damage to holders <strong>of</strong> property rights, <strong>the</strong>se may claim compensation.<br />
As <strong>in</strong> <strong>the</strong> Environmental Code <strong>the</strong>re are tresholds which <strong>the</strong> damage must exceed <strong>in</strong><br />
order to give ground for compensation, but <strong>the</strong> tresholds are somewhat differently<br />
def<strong>in</strong>ed. A serious impediment to property rights may force <strong>the</strong> local government to<br />
expropriate <strong>the</strong> property at market value. As is <strong>the</strong> case with o<strong>the</strong>r matters <strong>of</strong><br />
compensation, disputes between <strong>the</strong> parties can be resolved by a real property court.<br />
Disobedience <strong>of</strong> provisions under <strong>the</strong> Plann<strong>in</strong>g and Build<strong>in</strong>g Act may, and should,<br />
cause <strong>the</strong> local government to <strong>in</strong>tervene. It could <strong>the</strong>n decide on f<strong>in</strong>es, cont<strong>in</strong>gent<br />
f<strong>in</strong>es or, <strong>in</strong> <strong>the</strong> f<strong>in</strong>al <strong>in</strong>stance, <strong>the</strong> pull<strong>in</strong>g down <strong>of</strong> a build<strong>in</strong>g at <strong>the</strong> owner's expense.<br />
c. Protective measures and means <strong>of</strong> implement<strong>in</strong>g <strong>the</strong>m<br />
The designation <strong>of</strong> <strong>the</strong> m<strong>in</strong>e as a heritage site means that it is protected under special<br />
provisions (see Appendix 1). All archaeological rema<strong>in</strong>s (marked R on <strong>the</strong> map) are<br />
protected by law (see page 29). The Dalarna County Adm<strong>in</strong>istrative Board, located<br />
<strong>in</strong> <strong>Falun</strong>, is <strong>the</strong> supervisory authority <strong>in</strong> this connection. The County Adm<strong>in</strong>istrative<br />
Board also has at its disposal funds which can be applied to <strong>the</strong> care <strong>of</strong> build<strong>in</strong>gs and<br />
archaeological rema<strong>in</strong>s. In <strong>the</strong> context <strong>of</strong> national physical plann<strong>in</strong>g, <strong>the</strong> National<br />
Heritage Board has resolved that <strong>the</strong> <strong>Falun</strong> M<strong>in</strong>e and <strong>the</strong> town <strong>of</strong> <strong>Falun</strong>, toge<strong>the</strong>r<br />
with certa<strong>in</strong> <strong>of</strong> <strong>the</strong>ir surround<strong>in</strong>gs, are <strong>of</strong> national <strong>in</strong>terest. It is <strong>in</strong>cumbent on <strong>the</strong><br />
Municipality <strong>of</strong> <strong>Falun</strong> to show <strong>in</strong> its plann<strong>in</strong>g how <strong>the</strong>se sites are to be protected.<br />
d. Agency/agencies with management authority<br />
Responsibility for <strong>the</strong> property be<strong>in</strong>g cared for and managed <strong>in</strong> accordance with <strong>the</strong><br />
laws and regulations apply<strong>in</strong>g to <strong>the</strong> environment deserv<strong>in</strong>g <strong>of</strong> protection devolves<br />
