Response. Again, we do not believe that it is appropriate to define “diagnostic<br />

test result” in this <strong>final</strong> rule since the term is derived from the Medicare and Medicaid<br />

EHR Incentive Programs <strong>final</strong> rule. Consistent with other revisions we have made in the<br />

<strong>final</strong> rule, we have removed “procedures” from the <strong>certification</strong> criterion.<br />

Comment. At least one commenter requested that we clarify what Certified EHR<br />

Technology needs to be capable <strong>of</strong> meeting this <strong>certification</strong> criterion. The commenter<br />

asked whether the generation <strong>of</strong> a CCD or CCR would constitute compliance with this<br />

criterion or would the import and human readable display <strong>of</strong> both document types be<br />

required.<br />

Response. We clarify that compliance with this <strong>certification</strong> criterion can be<br />

achieved by demonstrating that the Complete EHR or EHR Module is capable <strong>of</strong><br />

receiving and displaying patient summary records that comply with either patient<br />

summary record standard (and if the alternative standard is used, displaying the non-<br />

natively implemented patient summary record standard in human readable format) and<br />

generating and transmitting a patient summary record according to one <strong>of</strong> the patient<br />

summary record standards populated with the specified data types and their applicable<br />

standard(s). For example, a Complete EHR designed to generate patient summary<br />

records in the CCD standard would need to be capable <strong>of</strong> generating and transmitting<br />

patient summary records in accordance with CCD. Upon receipt <strong>of</strong> a patient summary<br />

record formatted according to the CCR standard, the Complete EHR must also be capable<br />

<strong>of</strong> displaying the CCR-formatted patient summary record in human readable format. We<br />

clarify that we also expect that the Complete EHR designed to natively generate a CCD<br />

would be tested and certified as being capable <strong>of</strong> properly displaying any CCD that it<br />
