whether the requirement for customization would be met if a system administrator were<br />

to set the selected severity level to reflect the collective decision <strong>of</strong> a practice or if alerts<br />

must be tailored on an EP-by-EP basis. A commenter requested clarification on what<br />

qualifies as a "response" to an alert. One commenter recommended that the rule clarify<br />

that “responded to by a user” means in a way which meaningfully addresses the alerts. A<br />

couple <strong>of</strong> commenters stated that centrally hosted services would have problems<br />

complying with the customization requirements because the hosting vendor takes<br />

responsibility for the administration, maintenance and updating <strong>of</strong> the clinical decision<br />

support rules including alerts for drug interactions alerts, including drug-drug, drug-<br />

allergy and drug-problem. These commenters were c<strong>onc</strong>erned that allowing each <strong>of</strong> their<br />

clients to create local drug-interaction rules would slow their ability to provide important<br />

updates to their client base, since this would require navigation <strong>of</strong> a complex hierarchy <strong>of</strong><br />

preferred local rules. These local rules would also introduce clinical risk if old local rules<br />

could create a conflict with a clinically appropriate global, updated rule.<br />

Response. Based on the significant number <strong>of</strong> comments presenting diverse<br />

interpretations <strong>of</strong> these provisions, we determined that this <strong>certification</strong> criterion needed<br />

further clarification and have revised it accordingly. Our intention related to the alert<br />

statistics capability had been to mirror the clinical decision support capability. With<br />

respect to customization, we sought to provide users <strong>of</strong> Certified EHR Technology with a<br />

way to adjust the severity level for which alerts are presented. In response to public<br />

comment, and to clarify what we believe Certified EHR Technology must include as a<br />

condition <strong>of</strong> <strong>certification</strong>, we have removed the “alert statistics” part <strong>of</strong> the <strong>certification</strong><br />

criterion altogether and revised the “customization” part <strong>of</strong> the <strong>certification</strong> criterion to<br />
