multiple encounters. For an inpatient setting, they will need to enable the user to<br />
electronically record, modify, and retrieve a patient’s problem list for the duration <strong>of</strong> an<br />
entire hospitalization. This clarification was also requested in relation to the medication<br />
list and medication allergy list <strong>certification</strong> criteria and we have not repeated our<br />
response. As a result, we have retained “longitudinal care” in each <strong>certification</strong> criterion<br />
where the term is referenced and only make this clarification <strong>onc</strong>e.<br />
Comment. A commenter suggested that we include a reasonable expectation <strong>of</strong><br />
what constitutes “up-to-date” in the reference to “up-to-date” problem list.<br />
Response. We referred this comment to CMS, and it is addressed in the <strong>final</strong> rule<br />
on the Medicare and Medicaid EHR Incentive Programs.<br />

criterion to mean solely the retrieval <strong>of</strong> information available to Certified EHR<br />
Technology or if we intended for it to also include the interactive retrieval <strong>of</strong> medication
