Ten years after the first ECTIL project in this field,<br />
liability for medical malpractice is still a hot topic<br />
throughout Europe and it continues to expand and<br />
<strong>de</strong>velop. This study compares thirteen European jurisdictions<br />
on the basis of country reports authored<br />
by renowned experts from each legal system. In<br />
addition to providing a theoretical survey of key issues,<br />
contributors analyzed six hypotheticals based<br />
on actual cases, thereby also providing practical<br />
guidance on major aspects of liability claims.<br />

The goal of this study is to provi<strong>de</strong> a general overview<br />
and thorough analysis of how the European<br />
Court of Human Rights (ECtHR) <strong>de</strong>als with tort<br />
law issues such as damage, causation, wrongfulness,<br />
fault and compensation - namely when applying<br />
Art. 41 of the European Convention on Human<br />
Rights (ECHR). Methodological approaches to the<br />
tort law of the ECHR as well as the perspectives of<br />
human rights and tort law and public international<br />
law are also addressed.<br />

countries and will focus on the compensation of<br />
occupational diseases and acci<strong>de</strong>nts. Issues like discrimination,<br />
moral or sexual harassment and other<br />

in the reports for some countries. Major aspects of<br />
the reports will be a <strong>de</strong>scription of different existing<br />
compensation schemes, interactions between<br />
Employers‘ Liability and Workers‘ Compensation,<br />
a comparison of both systems and their respective<br />
efficiency.<br />
