Planning Authority Reports height, bulk, materials and colours of buildings and structures, and their appearance in relation to skylines, and to existing and proposed vegetation. The setbacks for five of the proposed shelters comply with the setback requirements, however one of the shelters is within 23 metres of Oldina Road and therefore relies on assessment against the Performance Criteria. The location of the shelter within 30 metres of the boundary to Oldina Road is not visually obtrusive in the area and will not detrimentally impact the amenity in the area. The location of the shelter and its low height means that it wont have any impacts in terms of overshadowing. All the proposed shelters are less than 7.5 metres in height (only 3 metres) and comply with the acceptable solution. The proposal meets the performance criteria. 7. Risk There is a risk the applicant or representors may appeal the determination of the Planning Authority to the Resource Management and Planning Appeal Tribunal. IN FAVOUR 8. Conclusion The application involves the construction of six animal shelters on site on a lot within the Primary Industries Zone. The land is currently utilised for grazing of horses and other livestock and a residential dwelling. The animal shelters are related to the primary industries use on site. The application is seeking a variation to the setback requirements for one of the animal shelters. The application is considered to not affect the amenity of the area, or affect the attainment of the zone or planning scheme objectives.
