PROVISIONS OF RELEVANT LEGISLATION<br />

St<strong>at</strong>e Envir<strong>on</strong>mental Planning Policy No 65 - Design Quality <str<strong>on</strong>g>of</str<strong>on</strong>g> Residential Fl<strong>at</strong> Development<br />

The applic<strong>at</strong>i<strong>on</strong> includes a design verific<strong>at</strong>i<strong>on</strong> st<strong>at</strong>ement by the project architect, Guy Lake <str<strong>on</strong>g>of</str<strong>on</strong>g> B<strong>at</strong>es<br />

Smart Architects. Mr Lake has verified th<strong>at</strong> he is a qualified designer and mem<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> the NSW<br />

Architects Registr<strong>at</strong>i<strong>on</strong> Board and has designed the proposal in accordance with the Design Quality<br />

Principles set out in Part 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> SEPP 65.<br />

The applic<strong>at</strong>i<strong>on</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en assessed in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the Design Quality Principles set out in SEPP65. The<br />

design quality principles do not gener<strong>at</strong>e design soluti<strong>on</strong>s, but provide a guide <str<strong>on</strong>g>to</str<strong>on</strong>g> achieving good<br />

design and the means <str<strong>on</strong>g>of</str<strong>on</strong>g> evalu<strong>at</strong>ing the merit <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposal. The assessment is as follows:<br />

C<strong>on</strong>text:<br />

‘SEPP 65: Good design resp<strong>on</strong>ds and c<strong>on</strong>tributes <str<strong>on</strong>g>to</str<strong>on</strong>g> its c<strong>on</strong>text. Resp<strong>on</strong>ding <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>text<br />

involves identifying the desirable elements <str<strong>on</strong>g>of</str<strong>on</strong>g> a loc<strong>at</strong>i<strong>on</strong>’s current character, or, in the<br />

case <str<strong>on</strong>g>of</str<strong>on</strong>g> precincts undergoing a transiti<strong>on</strong>, the desired future character as st<strong>at</strong>ed in<br />

planning and design policies.’<br />

The development is permissible and complies with the prescri<str<strong>on</strong>g>be</str<strong>on</strong>g>d requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> LEP194,<br />

including maximum height, site coverage, num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys and deep soil landscaping. The<br />

building setbacks <str<strong>on</strong>g>to</str<strong>on</strong>g> Nola Road are also acceptable <strong>on</strong> merit.<br />

The pavili<strong>on</strong> c<strong>on</strong>figur<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the structure is symp<strong>at</strong>hetic <str<strong>on</strong>g>to</str<strong>on</strong>g> the existing site c<strong>on</strong><str<strong>on</strong>g>to</str<strong>on</strong>g>urs, while a<br />

reas<strong>on</strong>able building footprint (32%) and FSR (1.23:1) have ensured th<strong>at</strong> more than 50% <str<strong>on</strong>g>of</str<strong>on</strong>g> the site<br />

remains deep soil planting. The landscape setting is maintained as the significant existing trees are<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> retained and the indigenous landscape regimen will serve <str<strong>on</strong>g>to</str<strong>on</strong>g> enhance the existing character.<br />

The n<strong>at</strong>ural envir<strong>on</strong>ment, forming a major part <str<strong>on</strong>g>of</str<strong>on</strong>g> the c<strong>on</strong>text for this development, c<strong>on</strong>sists <str<strong>on</strong>g>of</str<strong>on</strong>g> high<br />

canopy trees, including blue gums, which are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> retained; cre<strong>at</strong>ing a str<strong>on</strong>g sense <str<strong>on</strong>g>of</str<strong>on</strong>g> the n<strong>at</strong>ural<br />

envir<strong>on</strong>ment as a setting for the development.<br />

Scale:<br />

‘SEPP 65: Good design provides an appropri<strong>at</strong>e scale in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the bulk and height<br />

th<strong>at</strong> suits the scale <str<strong>on</strong>g>of</str<strong>on</strong>g> the street and the surrounding buildings. Establishing an<br />

appropri<strong>at</strong>e scale requires a c<strong>on</strong>sidered resp<strong>on</strong>se <str<strong>on</strong>g>to</str<strong>on</strong>g> the scale <str<strong>on</strong>g>of</str<strong>on</strong>g> existing development.<br />

In precincts undergoing transiti<strong>on</strong> proposed bulk and height needs <str<strong>on</strong>g>to</str<strong>on</strong>g> achieve the scale<br />

identified for the desired future character <str<strong>on</strong>g>of</str<strong>on</strong>g> the area.’<br />

Within the vicinity <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, there are a variety <str<strong>on</strong>g>of</str<strong>on</strong>g> building types comprising various heights.<br />

Immedi<strong>at</strong>ely adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> the site, are existing residential fl<strong>at</strong> buildings <str<strong>on</strong>g>of</str<strong>on</strong>g> four s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys and <str<strong>on</strong>g>to</str<strong>on</strong>g>wn<br />

houses <str<strong>on</strong>g>of</str<strong>on</strong>g> three s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys. Another development applic<strong>at</strong>i<strong>on</strong> for a residential fl<strong>at</strong> building in Kings<br />
