project 2.8 <str<strong>on</strong>g>to</str<strong>on</strong>g> 3 metres above n<strong>at</strong>ural ground level due <str<strong>on</strong>g>to</str<strong>on</strong>g> the 22% slope <str<strong>on</strong>g>of</str<strong>on</strong>g> the site. This is well<br />

within the KPSO height and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey limits set down by Clause 25K. The building façade is,<br />

however, set back 15.6 metres from the Nola Road secti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the fr<strong>on</strong>t boundary.<br />

Setbacks <str<strong>on</strong>g>to</str<strong>on</strong>g> the development generally comply with the specific c<strong>on</strong>trols for Special Area 1 as<br />

shown in Diagram No. 3. The building orient<strong>at</strong>i<strong>on</strong> displays a minor vari<strong>at</strong>i<strong>on</strong> in order <str<strong>on</strong>g>to</str<strong>on</strong>g> maximise<br />

solar access.<br />

The upper floor will <str<strong>on</strong>g>be</str<strong>on</strong>g> recessed from the perimeter <str<strong>on</strong>g>of</str<strong>on</strong>g> the building and further set back from the<br />

Nola Road fr<strong>on</strong>tage by approxim<strong>at</strong>ely 17 metres.<br />

The excav<strong>at</strong>ed driveway (within the side setback) does not comply with Clause 4.1 C-3 <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP 55<br />

as it allows <strong>on</strong>ly a 2 metre setback <str<strong>on</strong>g>to</str<strong>on</strong>g> No. 6 MacLaurin Parade. However, the positi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

driveway complies with the specific c<strong>on</strong>trols for the site as illustr<strong>at</strong>ed in Diagram No. 3. The site<br />

is c<strong>on</strong>strained <str<strong>on</strong>g>be</str<strong>on</strong>g>cause <str<strong>on</strong>g>of</str<strong>on</strong>g> its awkward c<strong>on</strong>figur<strong>at</strong>i<strong>on</strong> and limited road accessible street fr<strong>on</strong>tage<br />

(<strong>on</strong>ly 18 metres <str<strong>on</strong>g>to</str<strong>on</strong>g> Nola Road). The driveway, in this loc<strong>at</strong>i<strong>on</strong>, is loc<strong>at</strong>ed <str<strong>on</strong>g>be</str<strong>on</strong>g>low the adjacent<br />

property, does not directly affect any living areas and can <str<strong>on</strong>g>be</str<strong>on</strong>g> adequ<strong>at</strong>ely screened. C<strong>on</strong>diti<strong>on</strong>s are<br />

recommended <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure th<strong>at</strong> the noise <strong>at</strong>tenu<strong>at</strong>i<strong>on</strong> measures for the au<str<strong>on</strong>g>to</str<strong>on</strong>g>m<strong>at</strong>ic g<strong>at</strong>e <str<strong>on</strong>g>to</str<strong>on</strong>g> the car park<br />

are installed and maintained. (Refer C<strong>on</strong>diti<strong>on</strong>s Nos 66 and 98a).<br />

Part 4.4 Façade articul<strong>at</strong>i<strong>on</strong>:<br />

Clause 4.4 requires th<strong>at</strong> no single wall plane exceeds 81m 2 in area. N<strong>on</strong>-compliances are evident <strong>on</strong><br />

the north western and south eastern facades as indic<strong>at</strong>ed in Diagram No. 1.<br />

These minor numerical breaches <str<strong>on</strong>g>of</str<strong>on</strong>g> 15m 2 (96m 2 vs. 81m 2 ) are supported for the following reas<strong>on</strong>s:<br />

• At 18 metres wide, these elev<strong>at</strong>i<strong>on</strong>s are narrow and rel<strong>at</strong>ive <str<strong>on</strong>g>to</str<strong>on</strong>g> the <str<strong>on</strong>g>to</str<strong>on</strong>g>tal length <str<strong>on</strong>g>of</str<strong>on</strong>g> the affected<br />

boundaries, will not result in undue bulk and scale impacts.<br />
