14. The Revised Recommendati<strong>on</strong> of the OECD Council <strong>on</strong> Combating Bribery in<br />
Internati<strong>on</strong>al Business Transacti<strong>on</strong>s<br />
A first Recommendati<strong>on</strong> <strong>on</strong> Bribery in Internati<strong>on</strong>al Business Transacti<strong>on</strong>s was adopted<br />
already in 1994. In spring 1997, the OECD Working Group <strong>on</strong> Bribery reviewed this<br />
Recommendati<strong>on</strong> and issued a revised versi<strong>on</strong>, which was adopted by the OECD Council <strong>on</strong><br />
23 May 1997. This document pulls together analytic work <strong>on</strong> anti-corrupti<strong>on</strong> measures and<br />
commitments undertaken over the previous three years to combat bribery in internati<strong>on</strong>al<br />
business transacti<strong>on</strong>s. As the expressi<strong>on</strong> of a comm<strong>on</strong> political positi<strong>on</strong>, it is an important<br />
vehicle to encourage acti<strong>on</strong> by Member countries. Its implementati<strong>on</strong> is granted as it includes<br />
provisi<strong>on</strong>s c<strong>on</strong>cerning m<strong>on</strong>itoring and other follow-up procedures designed to promote their<br />
implementati<strong>on</strong>.<br />
The Revised Recommendati<strong>on</strong> invites member countries to '"take effective measures to<br />
deter, prevent and combat" internati<strong>on</strong>al bribery in a number of areas. In particular, it<br />
elaborates commitments in the fields of: criminalisati<strong>on</strong> of bribery of <str<strong>on</strong>g>for</str<strong>on</strong>g>eign public officials;<br />
accounting, banking, financial and other provisi<strong>on</strong>s, to ensure that adequate records are kept<br />
and made available <str<strong>on</strong>g>for</str<strong>on</strong>g> inspecti<strong>on</strong> and investigati<strong>on</strong>; and public subsides, license,<br />
government-procurement c<strong>on</strong>tracts or other public advantage that could be denied as<br />
sancti<strong>on</strong>s <str<strong>on</strong>g>for</str<strong>on</strong>g> bribery in appropriate cases. It also urges prompt implementati<strong>on</strong> of the 1996<br />
Recommendati<strong>on</strong> <strong>on</strong> the Tax Deductibility of Bribes to Foreign Public Officials and<br />
incorporates the proposals c<strong>on</strong>tained in the 1996 Recommendati<strong>on</strong> by the Development<br />
Assistance Committee <strong>on</strong> <str<strong>on</strong>g>Anti</str<strong>on</strong>g>-<str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> Proposals <str<strong>on</strong>g>for</str<strong>on</strong>g> Aid-Funded Procurement.<br />
15. African Uni<strong>on</strong> C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Preventing and Combating <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g><br />
The African Uni<strong>on</strong>'s Ministerial C<strong>on</strong>ference held in Addis Ababa <strong>on</strong> 18-19 September 2002<br />
approved the Draft African C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Preventing and Combating <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g>.<br />
This new c<strong>on</strong>venti<strong>on</strong> c<strong>on</strong>tains provisi<strong>on</strong>s that should guarantee access to in<str<strong>on</strong>g>for</str<strong>on</strong>g>mati<strong>on</strong> and the<br />
participati<strong>on</strong> of civil society and the media in the m<strong>on</strong>itoring process. Also noteworthy is an<br />
article, which seeks to ban the use of funds acquired through illicit and corrupt practices to<br />
finance political parties; and an article, which requires state parties to adopt legislative<br />
measures to facilitate the repatriati<strong>on</strong> of the proceeds of corrupti<strong>on</strong>.<br />
The African Uni<strong>on</strong> encouraged the participati<strong>on</strong> of civil society in the drafting and deliberati<strong>on</strong><br />
of the c<strong>on</strong>venti<strong>on</strong>. The c<strong>on</strong>venti<strong>on</strong> was presented to heads of state <str<strong>on</strong>g>for</str<strong>on</strong>g> adopti<strong>on</strong> at the AU<br />
summit in June 2003 in Maputo, Mozambique.<br />
16. SADC C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Preventi<strong>on</strong> and Combating <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g><br />
At any level, it has always been a fact of life that borders are porous no matter how well<br />
patrolled and, in this regi<strong>on</strong>, electrically fenced. Wars and strife in this regi<strong>on</strong> have also<br />
presented opportunities to all manner of smugglers and criminal organizati<strong>on</strong>s. These range<br />
from the bribing of customs officials at border posts and harbours to compromising<br />
immigrati<strong>on</strong> officers and any<strong>on</strong>e else in between. The seriousness of the problems created<br />
resulted in the SADC passing the <str<strong>on</strong>g>Anti</str<strong>on</strong>g>-corrupti<strong>on</strong> Protocol (the Protocol), which enjoins<br />
member states to pass relevant legislati<strong>on</strong> as a priority. At a c<strong>on</strong>tinental level, the Africa<br />
Governance Forum, scheduled as an annual event, is designed ‘to pursue collaborative and<br />
coordinated programmes in support of good governance’.<br />
The background to the Protocol is set <str<strong>on</strong>g>for</str<strong>on</strong>g>th as follows:<br />
The Southern African Development Community (SADC) Protocol Against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> was<br />
adopted by the SADC Heads of State and Government at their August 2001 Summit held in<br />
Malawi making it the first sub-regi<strong>on</strong>al anti-corrupti<strong>on</strong> treaty in Africa. The SADC Protocol<br />
follows in the wake of the Inter-American C<strong>on</strong>venti<strong>on</strong> Against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> of 1996, the<br />
European C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Fight Against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> of 1997, the OECD C<strong>on</strong>venti<strong>on</strong> <strong>on</strong><br />
Combating Bribery of Foreign Public Officials in Internati<strong>on</strong>al Business Transacti<strong>on</strong>s also of<br />
