2. THE BANGALORE DRAFT: Internati<strong>on</strong>al Code <str<strong>on</strong>g>for</str<strong>on</strong>g> Judicial C<strong>on</strong>duct<br />

Preamble<br />

WHEREAS the Universal Declarati<strong>on</strong> of Human Rights recognizes as fundamental the<br />

principle that every<strong>on</strong>e is entitled in full equality to a fair and public hearing by an independent<br />

and impartial tribunal, in the determinati<strong>on</strong> of rights and obligati<strong>on</strong>s and of any criminal charge.<br />

WHEREAS the Internati<strong>on</strong>al Covenant <strong>on</strong> Civil and Political Rights guarantees that all<br />

pers<strong>on</strong>s shall be equal be<str<strong>on</strong>g>for</str<strong>on</strong>g>e the courts, and that in the determinati<strong>on</strong> of any criminal charge<br />

or of rights and obligati<strong>on</strong>s in a suit at law, every<strong>on</strong>e shall be entitled to a fair and public<br />

hearing by a competent, independent and impartial tribunal established by law.<br />

WHEREAS the <str<strong>on</strong>g>for</str<strong>on</strong>g>egoing fundamental principles and rights are also recognized or reflected in<br />

regi<strong>on</strong>al human rights instruments, in domestic c<strong>on</strong>stituti<strong>on</strong>al, statutory and comm<strong>on</strong> law, and<br />

in judicial c<strong>on</strong>venti<strong>on</strong>s and traditi<strong>on</strong>s.<br />

WHEREAS the importance of a competent, independent and impartial judiciary to the<br />

protecti<strong>on</strong> of human rights is given emphasis by the fact that the implementati<strong>on</strong> of all the<br />

other rights ultimately depends up<strong>on</strong> the proper administrati<strong>on</strong> of justice.<br />

WHEREAS an independent judiciary is likewise essential if the courts are to fulfill their roles<br />

as guardians of the rule of law and thereby to assure good governance.<br />

WHEREAS the real source of judicial power is public acceptance of the moral authority and<br />

integrity of the judiciary.<br />

AND WHEREAS c<strong>on</strong>sistently with the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> Basic Principles <strong>on</strong> the Independence<br />

of the Judiciary, it is essential that judges, individually and collectively, respect and h<strong>on</strong>our<br />

judicial office as a public trust and strive to enhance and maintain c<strong>on</strong>fidence in the judicial<br />

system.<br />

The following principles and rules are intended to establish standards <str<strong>on</strong>g>for</str<strong>on</strong>g> ethical c<strong>on</strong>duct of<br />

judges. They are principles and rules of reas<strong>on</strong> to be applied in the light of all relevant<br />

circumstances and c<strong>on</strong>sistently with the requirements of judicial independence and the law.<br />

They are designed to provide guidance to judges and to af<str<strong>on</strong>g>for</str<strong>on</strong>g>d a structure <str<strong>on</strong>g>for</str<strong>on</strong>g> regulating<br />

judicial c<strong>on</strong>duct. They are intended to supplement and not to derogate from existing rules of<br />

law and c<strong>on</strong>duct which bind the judge.<br />

The values which this Code upholds are:<br />

• Propriety<br />

• Independence<br />

• Integrity<br />

• Impartiality<br />

• Equality<br />

• Competence and diligence<br />

• Accountability<br />
