presently the case. These provisi<strong>on</strong>s are intended to set minimum standards <strong>on</strong>ly. Countries<br />

can go further in bilateral or regi<strong>on</strong>al arrangements, and are in fact encouraged to do so.<br />

Under article 16, extraditi<strong>on</strong> from another State Party may be sought <str<strong>on</strong>g>for</str<strong>on</strong>g> the four specific<br />

offences established by the C<strong>on</strong>venti<strong>on</strong> independently of the involvement of an organized<br />

criminal group given the offence itself is punishable by the domestic laws of both States.<br />

Where extraditi<strong>on</strong> is refused solely <strong>on</strong> the ground that the c<strong>on</strong>cerned pers<strong>on</strong> is <strong>on</strong>e of the<br />

requested State Party’s nati<strong>on</strong>als, the requested State Party shall, at the request of the State<br />

Party seeking extraditi<strong>on</strong>, be obliged to submit the case without undue delay to its competent<br />

authorities <str<strong>on</strong>g>for</str<strong>on</strong>g> the purposes of prosecuti<strong>on</strong> (article 16, par.10).<br />

Also, States Parties may not refuse a request <str<strong>on</strong>g>for</str<strong>on</strong>g> extraditi<strong>on</strong> <strong>on</strong> the sole ground that the<br />

offence is also c<strong>on</strong>sidered to involve fiscal matters (article 16, par. 15).<br />

On the basis of article 18 the widest measure of mutual legal assistance can be requested<br />

from another State Party <str<strong>on</strong>g>for</str<strong>on</strong>g> any investigati<strong>on</strong>, prosecuti<strong>on</strong> or judicial proceedings in relati<strong>on</strong><br />

to offences covered by the C<strong>on</strong>venti<strong>on</strong>. The provisi<strong>on</strong>s of this article can be used to obtain<br />

statements or other evidence, c<strong>on</strong>duct searches or seizures, serve judicial documents,<br />

examine objects or sites, obtain original documents or certified copies, identify or trace<br />

proceeds of crime or other property, obtain bank, corporate or other records, facilitate the<br />

appearance of pers<strong>on</strong>s in the requesting state party, or any other <str<strong>on</strong>g>for</str<strong>on</strong>g>m of assistance<br />

permitted by the laws of the states involved (article 18, par.3). Since the range of <str<strong>on</strong>g>for</str<strong>on</strong>g>ms of<br />

assistance available is generally c<strong>on</strong>sistent with many existing legal assistance agreements,<br />

the major significance of the C<strong>on</strong>venti<strong>on</strong> provisi<strong>on</strong>s will be that these extend mutual legal<br />

assistance to a much greater number of countries than is presently the case. According to<br />

article 18, par. 8, States Parties to the <str<strong>on</strong>g>UN</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> shall not decline to render mutual legal<br />

assistance <strong>on</strong> the ground of bank secrecy.<br />

In additi<strong>on</strong>, the <str<strong>on</strong>g>UN</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> also provides the general basis <str<strong>on</strong>g>for</str<strong>on</strong>g> c<strong>on</strong>ducting joint<br />

investigati<strong>on</strong>s (article19), co-operati<strong>on</strong> in special investigative procedures, such as electr<strong>on</strong>ic<br />

surveillance, and general law-en<str<strong>on</strong>g>for</str<strong>on</strong>g>cement co-operati<strong>on</strong> (articles 20 and 27). The<br />

development of domestic training programmes and the provisi<strong>on</strong> of technical assistance to<br />

other States in training matters are also encouraged (articles 29 and 30).<br />

18. Protocol relating to the Mechanism <str<strong>on</strong>g>for</str<strong>on</strong>g> C<strong>on</strong>flict Preventi<strong>on</strong>, Management, Resoluti<strong>on</strong>,<br />

Peacekeeping and Security-ECOWAS 87<br />

With reference to the Accra declarati<strong>on</strong> <strong>on</strong> collaborating against corrupti<strong>on</strong>, ECOWAS, the<br />

Attorney-Generals and Ministers of Justice of the Member States of the Ec<strong>on</strong>omic Community<br />

of West African States (ECOWAS) met in Accra <str<strong>on</strong>g>for</str<strong>on</strong>g> talks <strong>on</strong> "collaborating against corrupti<strong>on</strong>:<br />

toward effective strategies and mechanisms". The ECOWAS Revised Treaty and the<br />

provisi<strong>on</strong>s of the Protocol <strong>on</strong> the Mechanism <str<strong>on</strong>g>for</str<strong>on</strong>g> C<strong>on</strong>flict Preventi<strong>on</strong>, Management, Resoluti<strong>on</strong>,<br />

Peacekeeping and Security give the mandate to ECOWAS Member States to eradicate<br />

corrupti<strong>on</strong> within their territories. Noting the limitati<strong>on</strong>s of the existing protocols, rules,<br />

regulati<strong>on</strong>s and norms against corrupti<strong>on</strong> within Member States and the Community at large,<br />

they expressed their determinati<strong>on</strong> to c<strong>on</strong>fr<strong>on</strong>t corrupti<strong>on</strong> collectively. The c<strong>on</strong>ference called<br />

<str<strong>on</strong>g>for</str<strong>on</strong>g> the harm<strong>on</strong>isati<strong>on</strong> of the laws of Member States in a protocol including extraditi<strong>on</strong>,<br />

financial disclosure and judicial processes, and <str<strong>on</strong>g>for</str<strong>on</strong>g> collaborati<strong>on</strong> between public, private and<br />

n<strong>on</strong>-state actors, including a free and resp<strong>on</strong>sible media.<br />
