instituti<strong>on</strong>s to report suspicious transacti<strong>on</strong>s, inter alia as well as cash deposits in excess of<br />

R10, 000.00 aimed at detecting and combating m<strong>on</strong>ey laundering.<br />

Article 10 of the Protocol obliges state parties to assist each other to the fullest extent:<br />

By processing requests from authorities that, in c<strong>on</strong><str<strong>on</strong>g>for</str<strong>on</strong>g>mity with their domestic law, have the<br />

power to investigate or prosecute the acts of corrupti<strong>on</strong> described in this Protocol, to obtain<br />

evidence and take other necessary acti<strong>on</strong> to facilitate legal proceedings and measures<br />

regarding the investigati<strong>on</strong> or prosecuti<strong>on</strong> of acts of corrupti<strong>on</strong>. State Parties shall provide<br />

each other with the widest measure of mutual technical co- operati<strong>on</strong> <strong>on</strong> the most effective<br />

ways and means of preventing, detecting, investigating and punishing acts of corrupti<strong>on</strong>.<br />

17. <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> against Transnati<strong>on</strong>al Organized Crime 86 *<br />

The <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> against Trans-nati<strong>on</strong>al Organized Crime, adopted by the<br />

General Assembly <strong>on</strong> 15 November 2000 and open <str<strong>on</strong>g>for</str<strong>on</strong>g> signature from 12 to 15 December<br />

2000 in Palermo (Italy), even though mainly aimed at the fight against organized crime<br />

includes several provisi<strong>on</strong>s related to the phenomen<strong>on</strong> of corrupti<strong>on</strong>.<br />

In particular, the C<strong>on</strong>venti<strong>on</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g>esees the criminalizati<strong>on</strong> of the corrupti<strong>on</strong> of public officials;<br />

the adopti<strong>on</strong> of such measures as may be necessary to establish as a criminal offence the<br />

participati<strong>on</strong> as an accomplice in such an offence; the liability (criminal, civil or administrative)<br />

of legal pers<strong>on</strong>s corrupting public officials; the provisi<strong>on</strong>s of measures to prevent detect and<br />

punish the corrupti<strong>on</strong> of public officials; the promoti<strong>on</strong> of the c<strong>on</strong>cept of "integrity" of public<br />

officials as well as the provisi<strong>on</strong> of adequate independence to competent authorities in the<br />

preventi<strong>on</strong>, detecti<strong>on</strong> and punishment of the corrupti<strong>on</strong> of public officials. The C<strong>on</strong>venti<strong>on</strong><br />

strengthens its provisi<strong>on</strong>s by stating that the offence of corrupti<strong>on</strong> shall be established, inter<br />

alia, independently of the transnati<strong>on</strong>al nature or the involvement of an organized criminal<br />

group.<br />

In particular, each State Party shall adopt such legislative and other measures as may be<br />

necessary to establish as criminal offences, when committed intenti<strong>on</strong>ally: i) the promise,<br />

offering or giving to a public official, directly or indirectly, of an undue advantage, <str<strong>on</strong>g>for</str<strong>on</strong>g> the<br />

official himself or herself or another pers<strong>on</strong> or entity, in order that the official act or refrain<br />

from acting in the exercise of his or her official duties; and ii) the solicitati<strong>on</strong> or acceptance by<br />

a public official, directly or indirectly, of an undue advantage, <str<strong>on</strong>g>for</str<strong>on</strong>g> the official himself or herself<br />

or another pers<strong>on</strong> or entity, in order that the official act or refrain from acting in the exercise of<br />

his or her official duties. In additi<strong>on</strong>, each State Party shall c<strong>on</strong>sider criminalizing the c<strong>on</strong>duct<br />

described above involving a <str<strong>on</strong>g>for</str<strong>on</strong>g>eign public official or an internati<strong>on</strong>al civil servant as well as<br />

the criminalizati<strong>on</strong> of other <str<strong>on</strong>g>for</str<strong>on</strong>g>ms of corrupti<strong>on</strong>.<br />

The <str<strong>on</strong>g>UN</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> introduces and promotes the c<strong>on</strong>cept of "integrity" of public officials and<br />

<str<strong>on</strong>g>for</str<strong>on</strong>g>esees that each State Party shall take measures to ensure effective acti<strong>on</strong> by its authorities<br />

in the preventi<strong>on</strong>, detecti<strong>on</strong> and punishment of corrupti<strong>on</strong> of public officials, including<br />

providing such authorities with adequate independence to deter the exerti<strong>on</strong> of inappropriate<br />

influence <strong>on</strong> their acti<strong>on</strong>s (article 9).<br />

In c<strong>on</strong>necti<strong>on</strong> with c<strong>on</strong>fiscati<strong>on</strong> and seizure, the <str<strong>on</strong>g>UN</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g>esees that States Parties<br />

shall adopt, to the greatest extent possible within their domestic legal systems, such<br />

measures as may be necessary to enable c<strong>on</strong>fiscati<strong>on</strong> of: i) proceeds of crime derived from<br />

offences covered by this C<strong>on</strong>venti<strong>on</strong> or property the value of which corresp<strong>on</strong>ds to that of<br />

such proceeds; and ii) property, equipment or other instrumentalities used in or destined <str<strong>on</strong>g>for</str<strong>on</strong>g><br />

use in offences covered by the C<strong>on</strong>venti<strong>on</strong>. For this purpose, each State Party shall empower<br />

its courts or other competent authorities to order that bank, financial or commercial records be<br />

made available or be seized. Sates Parties shall not decline to act <strong>on</strong> the ground of bank<br />

secrecy.<br />

The provisi<strong>on</strong>s of the <str<strong>on</strong>g>UN</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> dealing with extraditi<strong>on</strong> and mutual legal assistance are<br />

similar to traditi<strong>on</strong>al provisi<strong>on</strong>s already in place in many regi<strong>on</strong>al or bilateral agreements. The<br />

major significance of these provisi<strong>on</strong>s is that a large number of countries is expected to ratify<br />

the C<strong>on</strong>venti<strong>on</strong>, making legal assistance and extraditi<strong>on</strong> available much more widely than is<br />
