INTRODUCTION<br />

A. Background<br />

The <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>Guide</str<strong>on</strong>g> Practical Measures against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> was<br />

originally requested by the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> Ec<strong>on</strong>omic and Social Council<br />

(ECOSOC) in 1990 1 , and first published in 1992 2 by the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> <str<strong>on</strong>g>Office</str<strong>on</strong>g><br />

<strong>on</strong> Drugs and Crime (<str<strong>on</strong>g>UN</str<strong>on</strong>g>ODC), with the assistance of the <str<strong>on</strong>g>United</str<strong>on</strong>g> States<br />

Department of Justice. During the 1990s, issues relating to corrupti<strong>on</strong> were<br />

repeatedly raised within the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> and in other c<strong>on</strong>texts, 3 and in<br />

1995, ECOSOC requested that the <str<strong>on</strong>g>Guide</str<strong>on</strong>g> be reviewed and expanded, with<br />

c<strong>on</strong>tributi<strong>on</strong>s from other relevant internati<strong>on</strong>al organizati<strong>on</strong>s, to take account<br />

of new developments. 4 As the expansi<strong>on</strong> of the <str<strong>on</strong>g>Guide</str<strong>on</strong>g> proceeded, further<br />

developments took place, and the Secretary General was requested to keep<br />

the issue of acti<strong>on</strong>s against corrupti<strong>on</strong> under <strong>on</strong>going review, and to reflect the<br />

new developments in the expanded <str<strong>on</strong>g>Guide</str<strong>on</strong>g>. 5<br />

This process c<strong>on</strong>tinues, and further developments can be expected after the<br />

expanded <str<strong>on</strong>g>Guide</str<strong>on</strong>g> is published. As a result of discussi<strong>on</strong>s in the eighth and<br />

ninth sessi<strong>on</strong>s of the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> Commissi<strong>on</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g> Crime Preventi<strong>on</strong> and<br />

Criminal Justice, several further resoluti<strong>on</strong>s dealing with corrupti<strong>on</strong> were<br />

adopted by the General Assembly. These include:<br />

(a) Resoluti<strong>on</strong> 51/59 of 12 December 1996, which adopted an Internati<strong>on</strong>al<br />

Code of C<strong>on</strong>duct <str<strong>on</strong>g>for</str<strong>on</strong>g> Public officials 6 and requested a plan <str<strong>on</strong>g>for</str<strong>on</strong>g> its<br />

implementati<strong>on</strong>;\<br />

(b) Resoluti<strong>on</strong> 51/191 of 16 December 1996, which adopted the <str<strong>on</strong>g>United</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> Declarati<strong>on</strong> against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> and Bribery in Internati<strong>on</strong>al<br />

Commercial Transacti<strong>on</strong>s;<br />

(c) Resoluti<strong>on</strong> 54/128 of 17 December 1999 which directed the Ad Hoc<br />

Committee <str<strong>on</strong>g>for</str<strong>on</strong>g> the elaborati<strong>on</strong> of the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> against<br />

Transnati<strong>on</strong>al Organized Crime to incorporate measures against<br />

corrupti<strong>on</strong> linked to organized crime into that C<strong>on</strong>venti<strong>on</strong> and to explore<br />

c<strong>on</strong>clusi<strong>on</strong>s of the First Global Forum <strong>on</strong> Fighting <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g>.<br />
