Article 1*<br />

Statement of purpose<br />

The purposes of this C<strong>on</strong>venti<strong>on</strong> are:<br />

a) To promote and strengthen measures to prevent and combat corrupti<strong>on</strong> more efficiently<br />

and effectively;<br />

b) To promote, facilitate and support internati<strong>on</strong>al cooperati<strong>on</strong> and technical assistance in the<br />

preventi<strong>on</strong> of and fight against corrupti<strong>on</strong>, including in asset recovery;<br />

c) To promote integrity, accountability and proper management of public affairs and public<br />

property.<br />

Background<br />

Member States of the <str<strong>on</strong>g>United</str<strong>on</strong>g> <str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> have successfully finalised the <str<strong>on</strong>g>United</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Nati<strong>on</strong>s</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> against <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g>. Negotiati<strong>on</strong>s were c<strong>on</strong>cluded in<br />

Vienna <strong>on</strong> 30 September 2003 after two years of deliberati<strong>on</strong>s, The<br />

C<strong>on</strong>venti<strong>on</strong> marks a major step <str<strong>on</strong>g>for</str<strong>on</strong>g>ward in internati<strong>on</strong>al cooperati<strong>on</strong> against<br />

corrupti<strong>on</strong> has been included in the introductory part of this <str<strong>on</strong>g>Guide</str<strong>on</strong>g>.<br />

References to specific provisi<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong> have been added<br />

throughout the <str<strong>on</strong>g>Guide</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>Anti</str<strong>on</strong>g>-<str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Policies</str<strong>on</strong>g> where appropriate.<br />

The first sessi<strong>on</strong> of the Ad Hoc Committee was held in January 2002. At its<br />

first and sec<strong>on</strong>d sessi<strong>on</strong>s, the Committee c<strong>on</strong>cluded the first reading of the<br />

draft C<strong>on</strong>venti<strong>on</strong>. At the third and fourth sessi<strong>on</strong>s, the sec<strong>on</strong>d reading was<br />

completed. At the fifth sessi<strong>on</strong>, in March 2003, the Committee reached a<br />

preliminary agreement <strong>on</strong> a significant number of provisi<strong>on</strong>s.<br />

The sixth sessi<strong>on</strong> lasted a week l<strong>on</strong>ger than the previous five, including night<br />

sessi<strong>on</strong>s. After a debate lasting through to 3:50 a.m. <strong>on</strong> Saturday, 9 August<br />

2003, delegates from the 128 Member States decided to c<strong>on</strong>tinue working <strong>on</strong><br />

the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g>’s final details in a short, three-day seventh<br />

sessi<strong>on</strong>, which c<strong>on</strong>cluded <strong>on</strong> 1 October, 2003.<br />

Substantive Highlights of the C<strong>on</strong>venti<strong>on</strong> include:<br />

Preventi<strong>on</strong>. <str<strong>on</strong>g>Corrupti<strong>on</strong></str<strong>on</strong>g> can be prosecuted after the fact, but first and<br />

<str<strong>on</strong>g>for</str<strong>on</strong>g>emost, it requires preventi<strong>on</strong>. An entire chapter of the C<strong>on</strong>venti<strong>on</strong> is<br />

dedicated to preventi<strong>on</strong>, with measures directed at both the public and private<br />

sectors. These include model preventive policies, such as the establishment<br />

of anticorrupti<strong>on</strong> bodies and enhanced transparency in the financing of<br />

electi<strong>on</strong> campaigns and political parties. States must endeavour to ensure that<br />

their public services are subject to safeguards that promote efficiency,<br />

transparency and recruitment based <strong>on</strong> merit. Once recruited, public servants<br />

should be subject to codes of c<strong>on</strong>duct, requirements <str<strong>on</strong>g>for</str<strong>on</strong>g> financial and other<br />

disclosures, and appropriate disciplinary measures. Transparency and<br />

accountability in matters of public finance must also be promoted, and specific<br />

requirements are established <str<strong>on</strong>g>for</str<strong>on</strong>g> the preventi<strong>on</strong> of corrupti<strong>on</strong>, in the<br />

particularly critical areas of the public sector, such as the judiciary and public
